Oh yeah, and they'll all be spooked enough ("We lost MA? That means I'm not safe either!") to dither and delay long enough for the election cycle to begin in earnest and they won't have enough time to pass things and campaign to hold on to their own seats at the same time. If they don't have it done by November, it's not getting done period.

Senate law allows the minority party to force the need of a super-majority (60 votes) to pass certain legislation.

Yeah but the Republicans can delay any legislation they want indefinitely through a filibuster (basically they never let the debate end), and it takes 60 votes to break a filibuster and bring the bill to a vote. There were 60 democrats in the Senate. When Brown's term begins, in a couple weeks presumably, there will be 59.

also unintentional hate to break it to you, but right now the senate and the governor general are the only good parts of canadian government

no no, my problem with the senate is that even after the populous votes a party out, they still have stacks of senators until they turn 75

All legislators in the US are elected.

    1. Any legislation
    2. Some representatives and senators are appointed by governors if the incumbent dies while in office, but this depends on the specific laws of the state that elected them.

60 seats made a supermajority that prevented any sort of filibustering and other blocking tactics

Coakley and Brown were both idiots of colossal magnitudes and leave it to the rest of fucking Massachusetts to choose the greater of the two evils.

It was a compromise to keep negotiations over writing the new constitution from falling apart.

Basically, back in the late 1780s, when the constitution was being written, every state wanted to exert as much influence as possible in the legislature. Therefore, the big states said that the number of seats a state gets in the legislature should be determined by the state's population. The small states, fearing they would become marginalized, pushed for a legislature with a fixed number of delegates per state.

As a compromise, somebody suggested that we have both.

Actually, there may be precedent saying that they already have only 59 right now.
But in the days after the election, it is Kirk’s status that matters, not Brown’s. Massachusetts law says that an appointed senator remains in office “until election and qualification of the person duly elected to fill the vacancy.” The vacancy occurred when Senator Edward Kennedy died in August. Kirk was picked as interim senator by Governor Deval Patrick.

There are two separate elected houses as part of a compromise reached between states with larger populations and smaller populations when the country was founded. Smaller states didn't want to join a union with the other ones if it meant that they would be politically powerless and the larger states wanted to have their majority mean something.

There were other compromises too but they were less popular in retrospect.

Well, it's true that members of the military are more likely to have a medical condition that was a result of employment by the government than anyone else. That's just kind of the nature of it.

So, that's not really as unreasonable a position as it sounds.
