    How does sitting on the bench like a lump and using nothing more than a silent stare treat you? Because I'd love to see Thomas out of the court; I never hear anything positive about him and I guess he speaks like three times a year or something?

    He never speaks on the bench. Ever ever.

    He is, however, by all accounts a pretty personable guy off the bench. He just has... really weird ideas about originalism. If nothing else, he's at least more consistent about it than Scalia.

    That doesn't mean I wouldn't be happy for him to retire to get rid of his vote. He's only 63 though, so get used to him.

    Thomas is a terrible judge. And he has massive conflic of interest problems thanks to his wife being a conservative shill (and his refusual to recuse himself from ruling on issues his wife is involved in).

    Just gonna leave this here...

    Command Sergeant Major Allegedly Assaults Lesbian Captain at Military Ball
    The comments started flowing, and the soldier -- we'll call her Lucy (not her real name) -- who currently holds the rank of Captain, continued to explain the situation. While dancing with her girlfriend, another officer in her unit, at the Cavalry Squaldron Ball, Lucy's Squadron Commander took her girlfriend aside and told her, "You [both] need to stop dancing; the unit does not need this kind of publicity." When she asked what he meant, he said again, "You [both] need to get off the dance floor."

    Then, their Command Sergeant Major (CSM) approached Lucy and told her he knew what she was doing and that it was wrong. When she explained that she had no idea what he was talking about, he brought up the "Don't Ask, Don't Tell" (DADT) policy. Lucy explained:

    I reminded him that DADT was repealed... He then lowered his voiced and said, "You're a f***ing abomination, ma'am. You know what the f*** you did wrong and you're a disgrace." He stepped in closer to me within an inch of my face and told me to "have a good f***ing night, ma'am." I told him I didn't know why he was so angry and that I didn't do anything wrong. He then told me to "get the f*** out of my face." I remained calm from being absolutely stunned and confused by his behavior, and told him he was out of line; reminding him that I'm an officer he's talking to. When his threats didn't work and I didn't move, he shoved me hard across the dance floor and told me to "have a good f***ing night, ma'am."
    While Lucy says that the Squadron Commander called her girlfriend the following day to apologize and let her know "that he accepts us as being gay and it in no way changes how he feels about us as officers," she says he continued to assert that "the incident with my CSM and me was a misunderstanding and that I took it the wrong way."

    Yes. Generally the most extreme would be separation. Which generally means jack to someone eligible to retire. Something like confinement or reduction in rank are also possible, but he'd still likely decide to just get out then too. The best that can be made from this is the ensuing article 15 or court martial be highly publicized.

    No she was higher rank. Officers are always higher than enlisted. However there is a good amount off leeway for interaction between the senior enlisted and junior officers due to the generally large experience gap.

    A Command Sergeant Major is pretty damn high up as enlisted ranks go. Basically it's the top enlisted guy on any given base and/or unit. For a CSM to strike an officer (especially because she's gay) like that is going to be a bad lesson for the rest of the unit if nothing happens to him. The military is kind of a stickler about that kind of thing.

    Military balls generally have alcohol. People tend to cut loose and rent rooms at the hotel or whatever.

    And Krieghund is right. Whether or not the upper chain personally agrees with him most will be livid that the person who is supposed to be among the most responsible and respected role models demonstrated it's okay to attack higher ranking personnel because you don't like them.

    It could be that HE wants it buried by hoping it will go away. Pretty sure Capt Lucy can go above him if she feels it's not be handled fairly.

    Also I asked because I was at a Navy ball that was dry for one year. We had a large rash of DUIs and ARIs (Alcohol Related Incidents) that year so command clamped down. This was before Guam raised the drinking age to 21 though.

    Or somebody might make a call to the Army command about how discipline is kinda lax at this base and they might want to check it out. Of course, the same thing could happen the other way too. A lot of these guys are pretty old and set in ways that are, well, outdated lets say. Best thing that could happen is other news places pick it up and start asking questions of the brass, they hate that shit. They especially hate when somebody else screws up and makes thig uncomfortable for them.

    He's covering his own ass, he was the other person telling her to stop. Not in nearly as insulting or violent a way, but he was doing it.

    At E-9 (Sergeant Major and Command Sergeant Major) you're almost untouchable. Almost. It still doesn't allow you to hit anyone, let alone, a commissioned officer. Since the female Captain is bringing this up to the MP's, he'll probably be forced into retirement.

    The Squadron CO will probably get a negative OER for failing to enforce discipline and unit cohesion causing him to be passed up for promotion (If you're passed up 2 or 3 times, you're forced out). Since an OER stays with you for something like 5 years, chances are he'll be passed up again and be on track to separate/retire out.

    The female Captain will probably get a stern talking to. They'll probably crack down on discipline and everyone will go through another death by power point presentation on EO and the repeal of DADT.

    Really, we just need all these old, bigoted, fuckers out of the military because it ruins it for everyone, and we needed them out of the military before DADT was repealed. They are the reason why we can't have nice things.

    Not really. He can claim that but the Army's stance won't be known til after an investigation and possible court martial.

    @MuddBudd regardless of the reason, it's always bad juju to cause a scene. But literally the worse that'll happen to her is she'll be lectured about deescalating situations, regardless if she could or couldn't.

    Like what Quid said, it's not necessarily that she's being negatively counseled or punished or what have you, but it's more of a "could've handled the situation better even though you where the victim." Taken the issue above her CO using the chain of command (since it was her Squadron CO, going above to Brigade or Division or whatever). They'll finish by reinforcing the idea that what the CSM and CO did where unacceptable, that the military is accepting of a diverse range of individuals and to not let this negatively impact what career she has left, etc..

    Like Evigilant said, she could have taken it up the chain. Talk to an EO rep or her immediate supervisor or someone higher. Any would have required her to back down from what was happening at the time which would suck but is what she technically should have done. Note the emphasis.

    The military always, always, always prefers deescalation over physical confrontation between their people. And while I and everyone else with enough experience know that what she did will likely be better for her and definitely any other gay person lower ranking than that guy in the long run, the military is going to make sure she and likely everyone vaguely related to the two that there are rules and regulations dictating what one should do in such a situation. Whether or not one party is blatantly, horribly wrong is not relevant.

    And again, this will not negatively impact her in any way. It's just the shit part of being part of a giant, often uncaring bureaucracy.

    Yea it's bullshit but the military also tends to let it's chain of command be able to handle the issue rather than have it escalate up, unless it's an extremely serious situation. I'm not trying to say that what she did is wrong in anyway, I'm just looking at it as her leaders will: While she was the victim, there are other avenues she could have taken to deal with the situation (talk to the EO rep, they have the resources, facilities, and point of contact for people she could get in contact with to handle the situation. Utilize the chain of command, they would've pointed her to the EO rep, they would start a battalion investigation to determine if charges are necessary, the would prepare training for the rest of the battalion on EO, respect, etc...). Maybe she did and the article doesn't mention it, but all it does mention is that she went to the MP's (rightfully so, if someone is pushing you and harassing you, I'd call the MP's too AND then notify my chain what happened and whom I've notified).

    If it came out sounding like she was going to be punished that's an error on my part, I should have clarified more what "a stern talking to" meant. I'm not trying to derail the thread, so if anyone has any further questions about the military, chain of command, and whatever PM me and I'll try to elaborate as much as I can.

    Booker seems to be in the news kind of a lot recently, what with rescuing people from a burning building and now taking a strong stance against public referenda on gay rights. I only heard about him recently anyway; what are his odds that he'll be able to break into the national stage around 2016 or after?

    The man is really good at speechs and seems really involved and dedicated. If you havent seen the documentary Brick City, which I think was a show on IFC, I highly recommend it.
