    There's also something about privacy laws being such that you can't be compelled to disclose the results of a test for HIV, so the entire system is on shaky legal ground.

    This sounds like a political dodge for a guy who wants to vote for the bill but not be associated with the general backlash when it comes election day.

    There are two things to say here. First, that doesn't look like something that would fall under workplace health and safety legislation. Second, even if it did, enforcement is generally based on a complaint-initiated model, so if barebacking works for both people nobody will even know to get involved.
