I grant you that if there is a huge felony charge like murder 1, and a lesser charge of something like manslaughter or criminally negligent homicide, it is on a grey area case and 100% of the time he will be charged with the lesser felony.
If there is 2 charges of murder, there is some distinction between the two that the audience wasn't aware of at the start of the episode, and they will be charged with one of the two.
the last episode of SVU I watched involved a woman with down syndrome being raped by her boss at the grocery store and her wanting to take care of the resulting baby
did I mention this was also the the first episode I watched
i've lost most of my interest in L&O and SVU, because i feel like i've seen every episode and its so damn predictable nowadays. plus, goddamn that animal smuggling episode of SVU and the astronaut one this season were terrible.
