I think it's mostly down to people not really thinking things through. My acid test (particularly for the justice system) is to imagine myself being subjected to at as an innocent party.
It's like the thing with everyone arrested in the UK having their DNA sampled and recorded. People ranted about it when the European Court of Human Rights ruled that they weren't allowed to do that, because in their heads only criminals get arrested, and they're not a criminal, so would never be arrested, so it doesn't affect them.
