Toshiba announced they have succeeded in creating a 3 Layer HD-DVD disc, 51GB. They are seeking DVD Forum approval. All that would need to happen after that is players capable of reading 3 layered discs to hit the market.

3+ Layer BD-ROM discs have been on display in cases at electronics shows for a very long time now... but to the best of my knowledge they have never been demoed/proven to work. So for all we know that is just a piece of plastic, and not really a 100GB Blu-Ray disc.
It is still not cost beneficial to make 2-layer Blu Ray discs.
And making a 4 layer BRD now would cause all the PS3 owners to not be able to play movies imprinted on it. Sony has the most to lose by making a new BRD media, as they have the most disc drives on the market right now.

TDK's 200 GB Blu-ray disk is still single-sided—just like all other Blu-ray media—but crams six layers into each disk and 33 GB onto each layer, using a new signal processing innovation which extends the initial 25 GB-per-layer capacity set out for Blu-ray, but still staying inside the BD playback specifications.
They are, I've heard, working on an eight layer version.

I'd find it hard to believe that either company would produce a new player for a tri-layered disc in the home entertainment market. I think that would be suicide.

All I can say is that if you want to see actual industry voices weigh in on whats happening right now, you need only go to the Industry Insider Q&A thread at AVS to see that this is grounded in fact. Sony and the replicators who can make BRD has strict rules against pressing pornography. There are 40+ sites pressing HD-DVD, many of which don't care about pornography.
Porn studios are logically following the path of least resistance.

Blu-Ray needs to lose Apple and Dell from it's board and then they are dead in the water.
I hate to say it, but the chances of Dell dropping Blu-Ray outright are pretty slim. It'd take an absolute disaster to get them to do so. Something beyond the drives actually exploding, I mean -- they still use Sony batteries, after all.
More likely than not Dell will just do what they did with the +R vs -R war -- they'll put bi-compatible drives in all their systems and play both sides against the middle.
But yeah, this is a pretty stupid move by Sony. One of many, many, many stupid moves they've done lately. I mean, if you look at their choices over the past 2 years... how the hell did these jokers ever get to where they are? Was there really absolutely no competition for them for that long?

Sony replication will not handle pornographic product and I think many of other major replicators have similar policies. Nothing more than that.
The fact that BRD is hard to produce KEEPS lesser production lines from having a crack at it. The fact that Sony and the BRConsortium is still subsidizing the cost of pressing discs is further proof that the little guy CAN'T get into the game on this format any time soon.
HD-DVD has over 40 production lines right now, from big to small.
