Rent UK - Moving in date keeps being pushed back

I have a problem and I'm not sure of what legal recourse I have in this matter, because I'm not on benefits I am seemingly not eligible for decent free legal advice on this.

In March I was offered a job in Guildford, Surrey which was all well and good. I currently live in Bedford, Bedfordshire, a fair distance away. My wife and I immediately started looking for a place to live down here and on the first weekend in April (2nd) we went and saw a bunch of places that all advertised as available mid-april. We found a place we liked and were told that it would be available between 23rd and 30th of April, which was pretty much perfect since I would start my new job on the 3rd of May.

We immediately put down a holding deposit on it and started proceedings. We made sure at multiple points to confirm the dates with the estate agent and were told that 23rd was least likely but definitely no later than the 30th. So we handed in notice on our current flat meaning we'd have to move out by the 16th of May. as the 23rd approached we were told that it was not going to be that early but we were still on track for the 30th.

Then the 30th approached and we were told the 6th of May, I wasn't happy with this but after discussing it with the estate agents we agreed that it would be fine to move in on the 6th of May. This Monday I was told that it now couldn't be the 6th of May and would now have to be the 13th. I was livid and insisted that it couldn't be that date as I start work on the 3rd and while I had arranged living arrangements for this first week it would be impossible for me to arrange extra accomodation next week without going into extreme cost.

Tuesday they called back and said that it was now going to be the 23rd of May at the earliest. At this point I have now informed the estate agents that if the date isn't brought forward then I will have to begin legal consultation as the reason we put a holding deposit was the promised date range of mid to end of April. The estate agent has agreed to try and bring things forward to next weekend (14th May)

Their website still states mid-April availability: http://www.vickery.co.uk/details.php?&WCE=2108840&let=1&pageFrom=

The reason for delay that I have been told is that there is a 3 part chain associated with this property. The landlord is the current tenants mother, he is moving into a new home and his mother will be moving into his home, issues with his end of the chain (getting a mortgage agreement) have resulted in these delays. I have been told that the mortgage has only just been agreed (on Tuesday) and that completion date was original next Wednesday but will now likely only be next Friday.

The main problem for me is that I've started working in the area, it'll cost around £50 a day to travel next week as I have no accomodation, the week after that I am essentially homeless because of these delays.

Any ideas on what I can do? The costs so far have been pretty smothering and if this continues it is only going to get worse.

Have you signed any sort of contract yet?

Unfortunately not, generally contracts aren't signed and exchanged until the day you move in. Fairly common in the UK when renting.

We went through all the loopholes they requested. Currently the only written information regarding availability is in on their website which states mid-april. We were assured, in verbal agreement, on the day of viewing that the absolute latest date of availability would be the 30th.

I understand that verbal contracts are as good as the paper they are written on but at this point is has gone way beyond acceptable.

It varies, I'm renting in the UK too and generally I signed lease agreements when the lease was agreed. Have you tried the Citizen's Advice Bureau? They're often useful as a first port of call in this sort of situation.

I know it's not necessarily specifically helpful to your situation, but you should consider carefully whether you still want to move into this place knowing that the landlords are willing to dick you around before you move in. I had plenty of problems renting from people and/or companies that didn't start out sketchy.

I'm surprised you didn't sign anything when you paid the holding deposit. In the US at least, they always make sure you do at that point so they would have grounds to keep the deposit if things fall through. Otherwise, verbal agreements etc.
