I don't think a browser game could ever relentlessly tickle my funny bone the way my first playing of QWOP did - even making that image got a little smile out of me!
I think the bike thing is trying to approximate and mainstream pushing a shopping cart and hopping on the back. I saw one in the wild and it looked like the woman driving it was riding it to Burning Man.

Not really, because you can't go much of anywhere effectively while faceplanted. I managed to get to like 98m on QWOP by inching forward from the kneeling position.
For awhile I thought I had a solid strategy going by just using the front two legs exclusively, but...it turns out the designer accounted for that. (Try it for a minute, I laughed out loud when what happens happened.)
Garh man, I was at the doctor today. Went there to have a blood sample taken, after the nurse stuck the needle in I looked at the buildings opposite the window in the room and sort of started dreaming. I can't quite remember the dream but at the end of it I hear a distant voice saying my name and I'm like "whut?" and I open my eyes and I'm laying on one of those beds they have at the doctor's and I'm all "what?" and I'm super dizzy and the nurse gives me a cup of water. Apparently I passed out just after she had taken the sample and was gone for only 12 seconds or something, but damn, now I know how passing out feels.
WOOOH needles! On the way home I vomited twice...
I have only met one other forumer, @siegfried, and he moved 1,630 miles just to get away from me...
I've met Sieg a few times, Lexxy, Cheerful Bear, NightDragon, Bebarce, and IndyToad. I think that's it for the AC. In college I met a whole crew of SE++ guys and became pretty good friends. Hopefully someday I'll make it out to a PAX or something and get to meet/hang out with a few more.
I met a whole bunch of PA forum people when I was going to SDCC every year. Bogey is always an awesome dude to hang out with. I really want to get out to PAX East next year.
Bombs flew to me, and I met a few dudes from D&D in a denver meetup. So that was cool'n stuff. Was gonna try to meet up with Tam and Godfather in TX at some point.
Hey guys, I'd appreciate it if you would like to sign our (the MERP team's) petition to keep MERP (middle earth roleplaying project - for skyrim) alive. We received a cease and desist from Warner Brothers some time ago, I believe I have mentioned it here before. Anyways, any way you want to help, be it signing the petition or spreading the word, is much appreciated.
I'm not sure what the petition's going to do. If they think you're infringing on copyright (and I can't say they're out of line with that), then the more popular it is the more reason WB is going to have to go after you, because they'll see that popularity as directly proportional to lost revenue. You need a legal defense rather than an emotional appeal.
I cant support the cause, they payed top dollar for the rights to use those characters in their games. The petition makes no arguments, only a threat to boycott them for protecting their intelectual property. I know its nice to hit the big evil corporations for being "greedy", but in this case I dont see foul play on the side of WB but on the MERP team.

Yeah, while it's been a labour of love for you guys, I don't think you have much wiggle room on this one. You don't own the copyright so you don't really have the rights to produce a game using the characters from LotR. I'd love to support the cause as I'm sure the team has put in a great deal of time but I don't see how MERP could win the case. I know that if I paid a bunch of cash for the right to produce a licensed game that I'd be pissed seeing somebody else putting one together without having paid a cent. It's not really a matter of art or free use in this case. You guys have been creating a game without properly licensing the rights to use the names or any other intellectual property therein. While you may not be trying to make a profit on your work, it could inhibit the ability of the license holders to make a profit on their games since there is a competing product out there that is being given away for free.
It was suggested, I think in this same thread, that the names could be changed, as to not conflict with the trademarked ones, I read some of the comments about the MERP team, and the followers seem to be very enthusiastic about the product, they may not care about some things changed, specially if they know the reason of why the names are being changed. I cant remember who suggested it, or if it was in this thread at all, but Im sure I didnt dream of it.

There's no doubt they're in their right to do this, it's just a massive dick move. The problem isn't that our project might detract from any of their revenue, MERP doesn't coincide with anything they're making or have made. And this is more to prove that MERP isn't some small gig or something that they can just shrug off.
I do agree, though, that the choice of calling the petition "Save MERP from corporate greed!" is kind of hostile and childish.
BTW we're also working on a legal defense with a lawyer from Organisation for Transformative Works, and we're also trying to see what efforts we can make to make sure it is transformative.
Yeaaah. The thing is, is that if they let you do this, then they'd essentially be revoking their license, of what I remember of IP and copyright law? As soon as they let one person make something, it's okay for everyone to.
Not quite, but it does set a precedent which is then hard to argue against, legally. I don't know, this all seems pretty clear cut to me and honestly even if WB hadn't already licensed the characters I'm pretty sure all the IP is still under control of the Tolkien estate, so you're on shaky ground no matter what.
Well, we can always hope that they'll eventually let us pay a license fee. Like that The Hobbit pub. When their campaign escalated they were offered the chance to pay a license fee that wasn't something overly massive.
I think the difference there is that they never had any intention of opening up their own pub, whereas they do have the intention of making their own games. But still, I wish you the best of luck!!
See, a more appropriate response would probably be to write back and ask right now if you could pay the license fee instead of putting together a petition that is probably not going to win you any points. I think a lot of cease and desist letters are generally the first step in a negotiation in some cases. It all depends on how it's handled. Of course, I'm not an IP lawyer. However, after reading a lot of the copyright case information that has been going on, if you try to come to the table to gain some kind of licensing deal then at least you have that going for your case.
It doesn't really matter if WB has anything in the works right now that's similar to what MERP is doing. They could very well decide to do something similar. They have every right to do so. What happens then?
