Traffic ticket

edited August 2012 in Help / Advice Forum
My friend borrowed my car to apparently "go pick up his medication", a month later I got a $500 ticket in the mail. He refuse to pay or own up to it because " he has warrants out " should I just send th cops his way and have the police cart him away, I mean I can't afford a traffic ticket as I am currently on disability. What should I do?

Do you have any proof that he is the reason for the ticket or do you just know that day he borrowed your car?

He told me I'm borrowing your car, I can't drive du to seizures so, I wasn't driving, he's the only one to drive my car in like 3 months.

was it parking, or a moving violation? if it's parking, you are pretty much boned.

I think you might be able to sue your friend for the cost of the ticket, but it would probably be a tough case without concrete proof.

For one, he is no longer your friend if he's acting like this. If he wants to avoid the law can't he just pay you the cash and you pay the fine? Without proof, chasing him down if he keeps denying is probably not worth the aggro and you may just have to take the fine as a life lesson in who you can trust I'm afraid.

Is it possible to request the evidence photo in these cases? Might show it's him and give you some leverage in getting him to own up to his responsibilities.

Did it get a photo of the driver?

You should also consider getting rid of your car if you aren't allowed to legally drive it.

    1) Sell your car, use proceeds to pay off ticket

    2) Call your local anonymous tip line and let them know your friend's name and his current address.

I dunno where you live, but tickets from those cameras here allow you to sign a sworn statement that you were not the person driving the car if and only if you provide the name and address of the person who was. At which point your buddy is going to jail. So, have fun with that.

What is this I don't even.

I think this varies state to state. I have anecdotal evidence for oregon, that you can say it wasn't you, but you weren't sure which of your friends it was, and that's the end. Maybe this was just the cops being lazy in this case though.

What state are you in? People will be able to give better advice with that piece of information.

I live in Texas, and to everyone telling me to sell my car, I'm not allowed to drive for 3 months, after 3 months I'll be able to drive.

Looks like in Texas the liability goes to the owner. So turning your friend in probably won't help at all.

It's not the first time he's screwed me over, he's getting a visit from the friendly neighborhood cops.

    Kudos.

My advice. Get dressed up when you go to court. Explain the situation to the judge that you weren't able to drive because of a medical reason and ask for leniency since you can't afford the ticket. Be polite, dress nice.

not a doctor, not a lawyer, examples I use may not be fully researched so don't take out of context plz, don't @ me

U really think they will really care, they just want money. He said it was a yellow light, and last time I checked driving through a yellow light was not a ticket offense.

Yes, if you're polite about it.

Don't even bother arguing, just explain the situation, let them know you turned your friend in for it. See what they will let you out with.

Besides that, he allegedly has warrants out for him, and he's screwed you over before. Can you even be sure that what he's said is what actually happened? I wouldn't trust the word of somebody who acts like this, personally. But yeah, regardless, I agree with Bowen's suggestion. Explain what happened (citing your inability to drive due to medical reasons) and they might be able to work something out for you.

I just called the cops on him, apparently he has traffic fines as far back as 2007 and is wanted on drug charges and is wanted for dereliction of probation. Hello reward, goodbye ex-friend. Should I feel bad.

Newp, he treats his friends like there his own personal fall guys. He needs to learn his actions have consequences.

  • SammyFSammyF Registered User regular
You should not feel bad. Really this is an educational experience for your friend.

The lesson being "don't refuse to give your friend money to help settle a problem that you caused and then tell him that there's a bounty out on your head in the same goddamned breath, you stupid fuckwit."

Get a note from your doctor stating that you were unable to drive during that period. Or get some kind of documentation. Just saying "lol i culdnt drive tehn" won't do you shit. If you have something from a doctor stating that you are, indeed, medically unable to drive the car, then just helps your case.

Well, traffic light cameras can only catch people who are driving through a red light (or a yellow that turns while they're still in the intersection) so I'm pretty sure he's embellishing the truth. It may have been a judgement call, but it was a bad one.

Also it would be a hilariously bad decision to rely upon the word of the wanted fugitive you just turned into the police in a court of law.

What's the worse that happens? You're already on the hook for $500 that you can't afford because your friend's a goose. Worst case scenario you get charged $50 court costs on top of the 500 dollar ticket, best case the judge shows that he's human and lets you off the hook. I can't speak for you, but in my situation 500 bucks is worth the try.

Since you're on disability, I imagine you've got reams of doctor's notes telling you that you can't drive. Since it's a traffic camera, they've probably got a photo of the driver. Assuming you don't look like your friend that should be enough to convince them that you weren't responsible for the infraction.

Also, traffic cameras are stupid, they can't make a judgement call, they can't hold grudges. They've got their programmed triggers, if a camera sends a ticket it's because the rules got broken. Buddy may have said it's yellow, but if it turned red when he's halfway through the intersection? That's a red light. A cop might decide to let it pass, but a camera can't. After that it's all automated.

Like Bowen said, be polite, be presentable, be honest. Don't get angry, don't be a dick.

I'm more curious about how you get a 500 dollar ticket, even assuming he ran a red light.
The link I posted listed 200 dollars as the max, double in a construction zone, which would put it at 400. I guess if he was speeding too? Talk about a confluence of events... you almost have to try to max out fines like that.
