A friend just brought this to my attention. Kotaku published an article titled "The Guy Who Made Bayonetta Is Clueless About Valve and PC Gaming. That’s Common In Japan." - it's about Hideki Kamiya and was based on him saying "not interested" when asked about developing PC games. Like that's it, he's not interested, and it sparks a condescending article. So this stuff happened:

Those answers aren't that different from his normal Twitter feed. I think questions about Capcom's DmC (which he didn't work on) sent him over the edge.

Because its based on the same pinciples, design goals and themes. As well as being developed by a major designer on Torment as well as the setting itself and lead by the lead designer of Mask of the Betrayer that is frequently compared to Torment.
Also supported by the majority of people who ever worked on Planescape related stuff.
So, yes. Imo, that's a lot on why this certainly can call itself a spiritual successor to Planescape:Torment.

Nope. Can't copyright ideas, just the expression of them. If the trade dress and design was similar enough where somebody might in good faith be confused about whether they are buying PS:T or this new game, you might have a lawsuit, but challenging a decade-later game that uses a fantasy setting incorporating some thematic elements of planescape isn't a winning lawsuit. A large company with an active IP might file suit anyway in an attempt to bully out a competitor by leveraging the costs of discovery, but I would expect it to be tossed out with an early motion to dismiss.
