Part of me wants to say Snake is gone, because Keither Sutherland isn't showing up for sure, but then again, David Hayter isn't doing anything. Hard to say how Konami will want it, may depend on how much Kojima liked Snake in Brawl.
It wasn't Konami, Kojima pretty much begged Sakurai to put Snake in Brawl. Plus Kojima loves putting Snake in other games/having other games put in Snake Metal Gear games, and the impending release of MGS4 on another system wasn't a problem. Not to mention he's got a unique moveset. I'd say he's more likely than not unless a new Konami exec puts their foot down.
Other than that, yeah. I'd love Layton too, but I don't think Nintendo publishes the Layton series in Japan.

So though this is never going to happen, the Dissidia OST came on as was thinking about Smash Bros, and I realized that I would not be adverse to any Chrono Trigger party member showing up, or someone who hasn't appeared in Dissidia, such as Locke Cole. It's not as if at least half my time spent playing on my SNES wasn't in those two games.
