Am I out a Grand? (potential lost money order)

Hoping to hear I'm not utterly fucked....

I'm coming back from a long weekend trip and my roommate tells me we just got a notice for not paying rent.

Which is weird because on Friday morning I dropped off an envelope with a money order (I had run out of checks and didn't realize it) in their drop box right before I left for work.

Kinda freaking out that it somehow got lost and I won't be able to talk to anyone at the apt office till tomorrow. Anyone know what my options are?

I stupidly threw out the receipt too as I was cleaning out my car for the trip. I got the money order at my bank out of my debit card if it makes a difference.

    You probably will be able to get a refund if it hasn't been cashed (depending on the exact policies of the issuer), though they'll probably charge you a research fee (usually around $30 or so) if you don't have the receipt.

    if you purchased the money order from your bank, they should definitely have a record of the transaction. you should go to the bank and ask if they can provide a receipt. also, you dropped your rent off this last Friday and the landlord is already threatening eviction? when is rent normally due? that seems extreme...

    Was it a mailed notice? Because if they dropped it at the end of day on Thursday(12/31) it might not have gotten picked up till Saturday(1/2), and thus not delivered till today. Friday being a holiday and all.

    When was your rent due? Because if it was the first, getting a notice today after a holiday weekend is pretty amazing.

    Some states have a floating period for when rent is 'absolutely due by' date too, and give you until the 5th. (or 5 days after the due date)

    My rent is due on the first and I have until the third to pay. Yesterday was the fourth, and I already had the eviction/non payment notice.

    I just got off the phone with my bank and it seems my complex did cash the money order. I did make it out to them (as I thought I did) and was endorsed by their stamp and cashed on the day I dropped it off (the 31st).

    Really hope this is just a small screw up on their part and not some shady employee deciding to cash the money order for themselves somehow.

    If your bank has record of the check being cashed by the company and they are claiming nonpayment that is likely fraud! If they refuse to credit your account contact a lawyer asap.

    it is probably just a mix up

    if they are assholes about it then you move to the next step

    I've dealt with something similar before. One of the places I rented from doubled as section 8 housing.

    They are really no nonsense about rent, as soon as that last day rolls around, they will start motions for eviction.

    Apparently the rental company missed where I wrote my apt number, so the cash it but didn't know where to apply the funds. Problem is taken care off.

    Could have gone without the restless night, but oh well.

    If this happens again, check to see if your bank can send a check on your behalf, some banks do this (through their website).

    Contact your rental company and let them know that you spoke to your bank and they show the check was cashed on 12/31 by them. Worst case the rental company may want to see a copy of the deposited check, which your bank can provide to you.

    Its entirely possible that it is a clerical error and the rental company credited the wrong account and they can correct this right away.

    I'm sure the notice of non-payment is routine. The process of actually evicting a tenet is arduous and extremely expensive, the rental company would much rather you just pay the rent and speaking to them in a pleasant tone to sort out the issue will work 99% of the time.

    If this happens again, check to see if your bank can send a check on your behalf, some banks do this (through their website).

    When I rented I always had a check sent directly from my bank to the rental office so all liability for delivery is between the bank and the rental company, with complete coverage assured by the bank. When problems arise, then you can sick your bank on the rental company and believe me, banks have a much bigger bark and bite than your rental places.

    They cashed it without knowing where to apply the funds? That seems kinda bad to me, I mean if it had your name on it they could have at least looked it up by that.

    That requires actual work, most people don't like to do that.

    Or they have policies about "needing your account number on the check" or they will count you as late.

    But free money? Ain't no one turning that down.

    It's usually free and part of the bill pay section. The best part is once you set up the info it always prints your apt num and what it is for every time, be careful though sometimes it takes a few days to get to the rental company and it is debited from your account immediately so you can't drop a check to the apt on the 5th and wait for the float so it doesn't get deducted till the 7th.
