I've been fortunate in that I haven't had to wear a uniform for a job since highschool, where having a work-provided shirt that I didn't care wound up smelling like gas fumes was good.

Don't you wear a lot of red? CRYPTO COMMIE!

Yeah its one thing when you have it like that anyway, but when you call out the books specifically you kind of make your own bed there? Like saying xerox instead of photo copy.

I can't recall if velcro is one of those trade marks that have become too commonly used which can invalidate them, I don't think choose your own adventure is one of those though, it specifically calls attention to that brand of book.

If they'd waited a couple of years, it would've been 50 years after the trademark was made as well. Whoops.

...and of course, as always, Kill Hitler.

Is that what its called when a brand is used too much to protect the trademark? Like wasn't aspirin originally like a bayer trademark?

I know someone who had their ideas / molds stolen for how to manufacture something. It really sucked.

I think we overdo it a bit here. But I don't think the idea of patents at their base level are much worse than any other way of dealing with intellectual property.

    Google is monopoly that's different.

If companies still successfully defend their trademarks they aren't dead yet, I think those two companies are still able to argue they aren't dead yet in popular usage (maybe not bandaid)

Examples of trademarks that suffered genericide:

    Refrigerator
    Thermos
    Jetski
    Dumpster

So, whenever I hear someone say "Let me google that" on TV, they paid to use that?

It's more that there is no competition that google is being confused for, by using it in that colloquialism you're still not deluding the brand because you are almost certainly specifically using google.

I mean, they should have sought permission before using it. There are whole teams of people who hunt this stuff down on the behalf of TV shows to see if they have permission to use TV clips or products or songs and how much you have to pay to use that stuff. It's a cost of making any TV show or movie, built into it. They slipped up. Considering the music used throughout "Bandersnatch", it was probably a mistake on the part of their production team rather than an intentional misuse of copyright/trademark.

Google is probably not dumb enough to sue over something like that unless the context was maybe sufficiently awful
