    I had to depose a plaintiff, who really did not want to understand how a deposition works or why she had to answer my questions, so it was a lot of being yelled at by a witness whose counsel was doing his damndest to get her to calm the fuck down. I could have totally yelled back at her, especially when she was getting mean to the court reporter, but if I did that, she was going to completely melt down and we'd have to reschedule the deposition, and god, no one wants to have to do a second deposition, nor be the guy who goes back to the office to say "I yelled back a witness; she had a melt down, and now we have a new deposition date."

    On the upside, maybe we can settle this one for a decent price? Plaintiff's counsel is well aware of how bad a witness they have.

    Is it possible in the cases you work to know who is actually right about the case

    Well, of course I'll say yes, and clearly my client is in the right here. Based on what we know, plaintiff may have in fact gotten hurt in the exact way she claims to have (fallen, broke her ankle, got surgery for it). Based on the law, we shouldn't have any liability for it.

    Basically, she says that the saddle between her bathroom and hallway, in the apartment building she lived in, was a hazard that caused her to trip and fall.

    In essence, see the tapering (slanted part) of that saddle? She says hers should have been slanted the whole way like that. Hers instead tapers for a while and then ends with a vertical cliff of some fraction of an inch? She says that vertical portion was too large, so she tripped and fell. From what we know of the saddle, it's not too high vertically. We'll need to get an expert to inspect it at some point to confirm that.

    So basically, the saddle's not defective and built to code, so it's not our fault you got hurt. If the saddle's defective or not built to code, you have no evidence you ever notified anyone at the landlord about it the issue (she says she told someone 3 times, but she never put it in writing, despite having put other maintenance requests in writing, so you know...), and if you don't give notice of a defect, we're not on the hook for it. (there's a way around that, called constructive notice, but that's not applicable here really).

    So that's my long winded way of saying, we shouldn't have to pay a dime.

    I absolutely fell and ate shit yesterday running to get a pan of cookies out of the oven on one of those between my hardwood living room floors and my tile kitchen floors

    I have saved so goddamn much money since I switched my family from verizon to sprint about 8 months ago

    and we have better plans too. Everyone has their own separate unlimited data + 10gb of tethering (and it doesn't charge if you go over on tethering, just throttles).

    I'm terrified something like that will happen in our house. The shitlord we paid to install the hardwood floor said the plastic runners that those are supposed to clip to or w/e weren't necessary, and just glued them to the floor.
