Sony sued over Blu-ray
California company alleges patent infringements in PS3 maker's latest optical disc technology.

Given its global position as an electronics giant, Sony is quite familiar with patent law. The company is also quite familiar with the potential penalties for running afoul of patent law, as evidenced by the $97 million in damages and interest it had to pay Immersion Corporation in a dispute over the rumble functions in Dual Shock controllers.
While the two companies have since patched things up, Sony opted to leave rumble by the wayside when it was designing the PlayStation 3's motion-sensing Sixaxis controller. The electronics giant couldn't avoid patent headaches entirely, however, as Irvine, California-based Target Technology Company filed suit earlier this month, seeking damages for alleged patent violations relating to the Blu-ray technology used in the system.
The suit, which names Sony Computer Entertainment America, Sony Pictures, and Sony DADC, claims that products marketed under the Blu-ray name infringe on a patent it owns for reflective layer materials in optical discs. The patent addresses what Target called a need for specific types of silver-based alloys with the advantages (but not the price) of gold. According to the patent, the alloys are also more resistant to corrosion than pure silver.
Target does not specify in its suit whether it believes all Blu-ray discs infringe on its patent, or just a portion of discs manufactured in specific ways. The patent was filed in April of 2004 and granted in March of 2006.
Target is seeking a permanent injunction preventing Sony from violating its patent rights in the future, as well as damages with interest, multiplied due to what it characterizes as deliberate and willful infringement.
Sony representatives declined to comment, while Target's attorneys had not returned GameSpot's requests for comment as of press time.

What's the point in suing over a patent infringement that has yet to make money? You'd spend more money in court and lawyer fees than you'd actually get out of the whole shebang. The point in suing over patent infringements is to recoup losses that exist, not losses that might exist.

Well I'm going to go out on a limb here and say if they can't sell any more games on DISCS then they might be a bit up the creek.
If somehow the planets aligned and Sony actually LOST this lawsuit, they would probably end up licensing the Blu-Ray technology from this company that I don't know the name of and will probably never hear from again.

You can't patent something as simple as 'it uses plastic' anyway. Patents have to be different from other patents and are used for specific designs, processes or technologies.
At least, that's what I remember from my Design Prac lecture...

They've probably been sending letters to Sony for months accusing them of patent infringement (and asking for a settlement), and are only now launching a lawsuit.
But, it's probably frivolous anyway. Most patent lawsuits are.

The Blu-Ray Association was founded in 2002 and research into it probably didn't being that long before the group was formed. There is the question of when Sony decided to start using the alloy.
Let's be honest here, the timing of the lawsuit is obviously to maximize the size of a settlement from Sony. But that does not mean the complaint is frivolous.

I suppose they could always buy the patent off them, but the potential value of it would be probably in the order of billions of dollars.
What would be really interesting if then Microsoft would then do the ultimate hardball move and then buy the patent. THAT would be interesting to see.
I really doubt that these guys have any intention of taking it all the way and wrestling Blu-Ray away from Sony, even if their case is strong enough to make that even remotely possible. They just want a piece of the pie.
It is legit. This isn't just some random two men company, it is Target Technology, company behind silver alloy coating that is currently used in nearly all commercially pressed DVDs.
I really doubt that these guys have any intention of taking it all the way and wrestling Blu-Ray away from Sony, even if their case is strong enough to make that even remotely possible. They just want a piece of the pie.
Exactly. All they need to do is convince Sony that a judge might be persuaded that their claim is valid. Once they do that, Sony will possibly decide that it's better just to send a massive cash settlement their way, rather than face the risk of losing the case.
