It probably saved them more money while it was in effect then they lost in the settlement . So for that angle it makes sense to have it in official language. And after it becomes a problem say sorry and cut a check.

Here is a white paper (paywall) regarding some alternative individualized methods that try to avoid the (somewhat obvious) potential drawbacks. Race-Norming of Neuropsychological Tests. Neuropsychology Review volume 19, Article number: 250 (2009).
I have little doubt that the NFL took advantage of a flawed practice to avoid paying, but they didn't invent the idea out of wholecloth. Greed is going to greed.
