In general, how long should I wait before I report an item to eBay as not received? Is there some kind of rule about it? I can't seem to find much information.
I bought and paid for an auction item on eBay on May 27th, the seller told me it would be shipped the following Tuesday. I still don't have the item, and all of my attempts to contact the seller are without response.
I need this thing for my brother's b-day, which is in 14 days.
Technically, you can open an "Item Not Received" complaint 10 days after the close of the auction. However, eBay will not take any action on it until 40 days after the auction close date.
How did the seller ship it? Does it have a tracking number? Have you contacted the seller about the shipment?
Sometimes people get behind on their shipping, or flat out forget - best to contact the seller first and see if they have any information.
I've had situations where this happens and contacted the seller, and they say "I shipped it out on such-and-such (original) date", and then it shows up shortly after with a shipping date of just after I'd contacted them to ask about the shipping.

So basically, I could file an item not received now but it likely wouldn't make a difference until a week into July.... seeing as this guy is ignoring all my attempts to contact him. It also appears he doesn't have any auctions up anymore either.
Goddammit.... Guess I should start looking for a different b-day present for the bro.
RyakStorm: I've sent a number of messages to this guy over the past week or so, none of which have been responded to. He has given me no shipping information, there is no reason to believe he ever actually shipped the thing. The only contact I got from him was immediately after I paid him and he said he would ship the item on Tuesday (the Tuesday directly following May 27th).
How did you pay for it? Does the guy have good feedback? Does the auction say how he was going to send it (USPS, UPS, FedEx, etc)?

I paid immediately via Paypal. He's got 97% good feedback but a few comments about slow shipping and no communication. He didn't say how he was going to send it.

I'm pretty sure you are covered up to $2000 for fraud (which is what this sounds like). I'd send an email off to customer support (either eBay or Paypal, they are one company now) and ask them how to go about dealing with this. They'd tell you exactly what you should do to get your money back if the guy really is no good (rather than just slow to ship).
It could also be that he really is unavailable. Does he have an eBay store? Those have an "away" feature where you can mark yourself as on vacation or whatever. I assume PayPal links into that since they're owned by eBay.
Also, where do you live, and where does the seller live? For example, if you're in Canada and he's in the US, it can frequently take an excessive amount of time for mail to arrive.

He doesn't have an eBay store, nor any other listings on eBay currently. We're both in the US. If he shipped it when he said he would, there's no reason it shouldn't be here by now.
Looks like I'm covered up to $200 by PayPal if it turns out this guy really did take my money and run. I hope he just ships the damn thing instead of having this drag out...
How much are we talking? If its under the ebay refund limit... then stick with the policy .. you will get that cash back.
if its over the amount, or you suspect scam. Do not wait for ebay. Call your cc company (or bank if it was a checking / checkcard) and get the charge reversed.
it is so absurdly easy for this guy to scam you out of money... and have ebay rule the issue dead. You will please note that ebay says wait 45 days.... while your cc dispute options generally run out within 30 days.
if its any signifigant amount of cash... i would call and get it charged back yesterday.
Technically, part of the paypal user account terms is that you waive your right to do a chargeback. I have no idea how they'd enforce it, though.
Look, sometimes the seller just doesn't talk to anybody. I know I had a problem with an item where it took like two weeks to get to me and the seller never answered a single goddamn e-mail.
I left negative feedback for that one, even though I got the item, because the seller pocketed my insurance fee instead of insuring my package.

My fiancee tried to buy me Animal Crossing for DS when it was not available in stores. She bought it from an eBay auction, for $30, which was cheaper than most stores were selling it anyway (should have been her first warning ). When the jackass didn't send it, she e-mailed eBay, and the guy's account was suspended. Paypal refunded the money to her, even though his account was empty. It doesn't matter if there's money in there or not... Paypal will generally take care of you, if only to keep bad press down.
It is the time of year when people go on vacation. That might explain his unavailability, and if he had the package waiting by the door to remind him, and it failed in that capacity, uh-oh. I do admit though, that even when I'm on vacation, I still check my e-mail, so it's not like I'm saying the guy should be in the free and clear.

Well. Upon closer inspection it appears PayPal withdrew funds from my checking account to pay for this auction instead of using my credit card. There goes the charge back idea...
Seems like all I can do now is sit and twiddle my thumbs. My hope is that if he's ignoring email from me, maybe he won't ignore emails from PayPal and eBay.
Not always so... if you have a check card tied to your account... and it has the visa logo... you can charge back just like any other cc.
Try calling the bank anyway. As long as its not 'John John & sons Bait & savings' .. they should be savy enough to get your money back.

Well guys, I finally got my money back today and I have to thank you for your help with that.
However now I have a new problem.
Under MyEbay Summary, it now says that I haven't paid for that item and that I still need to... however when I check the item details, the order total comes to $0.00
EDIT: However, when I click "Pay Now" the total goes back up to what it used to be.
I think you should have a "Mark as payment sent" in the Action box. I would do that, or just ignore it. Sometimes the MyEbay summary doesn't keep up with your auctions very well. It's really more a reminder for you rather than a "You must pay now or your account will be canceled!!!!!" type of thing. I don't think ebay really cares what it says on that page.

I just don't want to get punished for nonperformance or some bullshit.
Did paypal refund your money? If they did, or ebay did (since ebay owns paypal), I think you have very little to worry about. If they give you grief later you can explain your situation and it will all work out.
Just as an FYI on how ebay will punish you/suspend your account:
I've been on ebay for 10 years or so. A year or 2 ago my wife asks me if there is something up with our account, as she can't log in. I try to log in and it says our account was terminated for some really vague reason. I write them an email (I couldn't find a number/get thru, I don't remember exactly) asking wtf is up. They say that my account is suspected of being fraudulent, that they don't believe that I am who I say I am and that I have multiple accounts. I am thoroughly confused. Then they tell me the name of one of "my" other accounts, which does sound vaguely familiar. After thinking about it for awhile, I remember that a guy I used to work with used that account. I called the place I used to work at (like 2 years prior) and talked to this guy. He said that it was his account, and that he had not paid for some stuff because he was a dipshit. Well, he didn't say he was a dipshit, but he was. Anyway, since he and I (and a few others) would check out stuff on ebay during breaks/slow times on the same work computer, ebay thought we were all the same person. I ended up having to fax them a copy of my driver license. I put a note on there that I was rather upset that they didn't contact me before canceling my 100% positive feedback 10 year old account. By the end of that day my account was back to normal and they sent me an apology.
Damn, that was long winded. Anyway, in my experience, since you have done nothing wrong, you won't have any problems with ebay (at least ones that can't be fixed by emailing someone).
