Some confusing jazz happened recently, and i wanted to get a second opinion... Id like to know what you guys think about it.

I moved into an apartment a few months ago. It came unfurnished, except for 1 couch that was to be leaving soon (It was the last tennants, but the fellow in the next apartment bought it off him and just neglected to get it before i moved in, like the landlord told him to).

I had my own couch so i pushed his to the far wall and reminded him to get it. A month went by, the couch was still brooding in my livingroom. 2 months of reminders later, the dude downstairs moved out... didnt come up to get his sofa (by the way, he is a dick in general). I celebrate by starting to use it, because its badass.

ANOTHER MONTH; yesterday. He shows up on my doorstep and wants it back. He paid 100$ for it you know, and he has nowhere to sit. I considered my options...
Could i have taken it outside by the curb as soon as i moved in, and left it? If it wasnt a comfy couch i would have. Does he owe me for storage space? Is it really his anymore?

What would you have done, either legally or morally?

    If you hadn't used the couch, I could see where you could ask for some storage space moneys. I'd have chucked it out to the curb a long time ago. But, it seems right that he should get it back. The fact that he's a dick isn't really relevant.

    No, it doesnt make it more right or wrong if hes a cockmaster.. it just makes it harder for me to agree to any terms that work in his favor :(. But i didnt feel right about using the couch untill i knew he had left, at which point i guess i assumed his pothead brain forgot he had a couch to begin with.

    Haha... dammit. That may have actually worked if i moved it. The guy didnt give me any advance warning though, he just showed up. Would i have any right to dump it if he didnt get it when he was told to?

    I think you played the nice guy which is good, but you had the right to keep it/chuck it out.

    I mean if you ask someone to hold your... I don't know... Basket of yummy chocolate eggs, and walked away to return two hours later, it is common logic to expect that person to have since left.

    Or eaten them.

    This should probably be in H/A, but whatever. You should give him the couch but not until he gives you some storage money. It doesn't matter if you used it, he left it in your care instead of taking it when he should have, so he owes you something for the inconvenience.

    Gave him his couch.
    He might be a total dick and sue, and he has an argument, considering he paid for it.
    You were never told to keep his couch, and thus he isn't obligated to pay you for a service you never sold.
    Just give him his couch back man.
