Oh, these are sold numbers all right. SOLD TO RETAILERS. Othewise known as shipped. Add them up and see what you get.
These numbers are from MS themselves, plus 4.3 million estimated shipped this holiday season. The 360 isn't quite sold out everywhere, and I really doubt that they moved 6.1 MILLION 360's in the last half of '07.

Hm...maybe we'll get N+ out of this. I know it's scheduled to be released soon and I don't know how many people would buy it if it's not free since it doesn't look much better than the free PC version. It's really quite good. It's enough of a change to the formula to make it feel more like PacMan 2. It's a logical sequel. It adds a bit more strategy and puzzle feel to it.
A good choice for a "I'm sorry" gift. I already have it though.

Except in this case the reimbursement would be a free week of XBL. Which would probably cost me about $2, since a month XBL card is $8.
I'd rather take the game. It's more akin to subscribing to a magazine about cars, and missing an issuse, so in return they give you a free car part. Kinda.

I can see what you're trying to say, but the restaurant analogy doesn't work. In a restaurant, you usually pay for your meal afterwards, so if the waiter says, "We'll get you some lobster instead for the same cost" and I didn't like lobster I'd simply decline it and no harm done.
In this instance, Gold members have already paid for their membership. Microsoft refunding customers would result in a lot of cheques for $3.75 being generated for people who pay for their account via membership cards, and I don't know anyone who can be bothered to walk down to the bank to cash a cheque for peanuts and pennies. I mean, I still have a cheque from Nestle for £6.00 I haven't cashed yet. Microsoft pay for the cheques to be generated, and how many of them are going to be cashed? Realistically, I'd say far less than 50%. Microsoft win that one, too.
From what I have learnt from conversations with people at companies such as Team17, Microsoft don't get all that much from the sale of Live Arcade titles anyway. Certainly they get less than $3.75 from the sale of a $6 game...

Your analogy is TERRIBLE, just stop. XBL never completely stopped working, your XBox didn't completely stop working. There were intermittent issues with the service. If XBL not working somehow stopped me from using my XBox at all, your analogy might be valid, maybe, and even then it's a stretch.

I was still able to play all my XBLA games, NO PROBLEM, even with the service was sketchy. It may have taken a few minutes, but it worked. The only thing that didn't work was the parts of the service I pay for (aka I couldn't get in to Halo 3 games). I PAY for that part of the service, thus I have a right to compensation...but all the XBLA games that I've already paid for and are on my HDD were working just fine.

You're forgetting the many, MANY people who had to replace their 360s and can now only access their downloaded games when the console is connected to the Internet.

From what I have learnt from conversations with people at companies such as Team17, Microsoft don't get all that much from the sale of Live Arcade titles anyway. Certainly they get less than $3.75 from the sale of a $6 game...

What does the HDD have to do with anything? You can have a fucking 360 elite and still be a silver member. it all depends on whether or not you want to play games online.
Silver members can still go online and buy things, XBLA titles, HD movies, TV shows. The only thing they cannot do is play online. Sure, playign online is a big part of XBL, but it is not the only part.
Why shouldn't they be compensated when they have been affected by this whole thing too.
Your analogy is TERRIBLE, just stop. XBL never completely stopped working, your XBox didn't completely stop working. There were intermittent issues with the service. If XBL not working somehow stopped me from using my XBox at all, your analogy might be valid, maybe, and even then it's a stretch.

The fact that MS is giving anyone anything at all is a nice gesture, and rather than taking it at face value, everyone has to do the typical pessimism bullshit. It's getting tired, especially from people it doesn't affect in the first place.
There are people who were in the middle of downloads that got interrupted, like a movie download where the person could not finish the movie before the 24 hour time frame was up because the download never finished.
What if a dude had to be connected to access his XBLA games thanks to DRM and him being on a 2nd Xbox? He couldn't then play his XBLA or access his DLC.

Because you don't pay for the damn service, which means you can sit in the back of the room and smile until you do. I was still able to play all my XBLA games, NO PROBLEM, even with the service was sketchy. It may have taken a few minutes, but it worked. The only thing that didn't work was the parts of the service I pay for (aka I couldn't get in to Halo 3 games). I PAY for that part of the service, thus I have a right to compensation...but all the XBLA games that I've already paid for and are on my HDD were working just fine.
Silver Members should be happy they are getting the compensation, but seriously, you don't pay anything for XBL, so just smile and nod and take what amounts to a free game for you.
Then that is a separate customer service issue that Silver Member needs to take up with MS, because they didn't receive a product they paid for....but to sit and bitch like they deserve a free game for a service they don't pay for is silly.

My main point is that I agree when you say that "It's the value of the product the consumer gets in the end that's the important thing" but that the consumer should be the one to determine value, not Microsoft. Who the fuck are they to tell me that a game I may or may not want is worth equal or greater than a service I paid for and did not get.
You're forgetting the many, MANY people who had to replace their 360s and can now only access their downloaded games when the console is connected to the Internet.
