Well, myself a Gold member, I can't help but feel like I'm entitled to more reimbursement for my inconvenience compared to a silver member. I was inconvenienced the same as any silver member, except I get the added boost of having paid for the inconvenience.

I will reiterate--silver members also paid for the service which included inconvenience. Although (potentially) not as much.

I picked up a 360 after X-mas, but couldn't even get my Gamertag registered until New Year's Eve. I get a free 1 month Gold subscription with my machine- does THAT entitle me to more compensation, or less?

Sorry. I'm quite pissed off about my particular Live gripe.

    How's that going, anyways?

Perhaps they should tally up games purchased total and see who spent more money as a result of their ability to use a silver account on Xbox Live, and create a solid monetary basis, or even more appropriately, divide that over the number of months they bought that, since we are comparing it at a per-time basis. Or they could create tiers based on the amount of money spent--say people that have bought a lot of games, or have had a gold membership for over a year get something really great while new purchasees and people that have spent less money can get less.

Alternatively, everyone can get the same damn thing, and what you get as a gold member is whatever features gold members get, and if you dislike those features, I'm sure they'll let you no longer pay for said services.

Bollocks to that, they should be refunding everyone's subscription fee for that period.

Or at least a month free.

You do realize that what they're going to give away will be worth a good deal more than a month of XBL right

Also that the downtime was less than a month, so insisting on "at least" a month is kind of silly right

I mean seriously did you think before you made that post or not

You're an asshole. What you're getting is worth far more than you paid for the very small period of inconvenience that you suffered. Now you figure you deserve even more because they're also giving it to others you personally feel to be less entitled than you?

But a Silver member with more Marketplace content than the value of your Gold sub for Dec + content is (potentially) more entitled than you.

See how differentiating between the two is futile? Your membership status is not an indication of how inconvenienced you were because status gives no indication as to the value of content you were prevented from accessing.

Should a Gold sub with 2 XBLA games get a bigger compensation than a Silver sub with $200 worth of content he couldn't access? All because a $4 Gold sub for December?

Man, some people just bitch for the sake of bitching I think. To all the people that are crying, what is it you want MS to do? They admitted they messed up and that the situation was unacceptable, and now they are offering a free game to make up for that. They really don't have to do anything. They could have just as easily said sorry about that, done nothing and moved on.

An asshole? You have no idea!
I know for a fact that I personally am not as entitled, because I didn't use my xbox at all for the shortage period.
But I still think I should be compensated more, just for being a gold member! I think when you take everything into account, on average the gold members will end up with the most amount of inconvenience. I'm sure there's some silver guys out there with just loads of content they didn't get to use, but I bet there are enough gold members out there to match up. I base this on nothing but a hunch!

I was just telling you guys how I felt about it! I'm not going to take this up with my congressman or anything.

I'm pretty sure the reason they said "coming weeks" is because it IS a new, unreleased game. Which makes a LOT of sense because it's the only way they could possibly guarantee that nobody was going to receive something they already paid for.

I mean, the only other solution would be to let everyone just pick one out of the catalog, but something tells me they're not going to go that route. They know they have hits in there that a lot of people haven't bought but eventually will. They don't want to prevent any sales, so they'll give away something that nobody's had a chance to lust over or build up any real desire to own yet.

I'm also willing to bet it'll be a sequel to an existing title.

I think consumers have shown MS that theyre more than willing to put up with a truckload of shit to play the 360... Ive lost count of how many times I read something along the lines of:

"My 360 broke for the 3rd time, they kept sending me refurbs that broke weeks later.... so I went and bought a brand new elite!"

With customers like that, why even try?

In the license agreement you agree to when signing up to XBL Gold Accounts it specifically states the maximum you can claim in compensation for outages or poor performance ie breaching their end of the deal is one month subscription fee.

Fucking Hell abducens you act as if no-one who owns a 360 could ever buy another console, or has ever owned another console before. And on this board, of all places.

Just because you are a shitty hate filled troll who does nothing on this forum but plague every Microsoft thread with twatty rhetoric doesn't mean that no-one else can come to their own conclusion about a service.

When people feel like they are getting the shaft from Microsoft to the point where the service does not justify the hassle / expense, they will stop paying for it, and use an alternative.

Fact is, despite the recent fuck-ups, the service as a whole has been pretty damned excellent.

That does not mean that when shit goes wrong the actual users are not entitled to bitch about it.

see, you guys don't understand, it's the american way, to try to squeeze as much money/value as they can out of a minor inconvienience.

3 Men in Texas sue Microsoft for Xbox live outage

    5 fucking million dollars?!?!?!

What the fuck people. Now, I know that the majority of americans are not like this, but this sure makes you guys look bad.

Honestly, it just sounds to me more and more like you are trying to squeeze as much out of it as you can.

MICROSOFT DID NOT HAVE TO GIVE YOU SHIT. and they are offering you something worth more than what 2 weeks of a live subscription would cost. and you are Bitching because everyone gets it, instead of the people you feel are "better" because they are gold subscribers.

    It makes me sick.

Boo hoo poor microsoft? Why wouldn't a person want to squeeze as much out of it as they could?

Why would they? I don't want to squeeze more money from company X than company Y just because "IT'S BIGGER". People who think like you are a plague on this society. Now everyone has to legally protect themselves in every single way to avoid lawsuits from raging egoisitcal assholes and everyone loses in the process.

Edit: They would do it because 5 million dollars is a lot of money, for them and the people that they care about. If I were given the option of receiving 5 mil from some company I don't give a damn about (any) I would take it without weighing the moral consequences of what a plague on society I am. So sorry for the inconvenience of having to breathe the same air as me.
But, this is derailing the thread, I appreciate fully what a giant asshole I am who deserves to rot in hell. Enjoy Checkers HD or whatever we get.

Seems like the assholes win, and as it's been made clear, that very includes me! And 3 guys in Texas, I guess! Which is a good thing 'cause we got bills to pay.

So it's come down to this in the US has it? Suing people because "you got bills to pay"? That's awesome.

I guess I'll just have to put up with the legally protecting myself in every way possible - a practice which I personally, along with the other three texan knights of the apocalypse, am the cause of. Sorry for the inconvenient plague on your society, there.

Legally protecting yourself? From what? The outage of a $4 service? Not playing video games?

In the license agreement you agree to when signing up to XBL Gold Accounts it specifically states the maximum you can claim in compensation for outages or poor performance ie breaching their end of the deal is one month subscription fee.

Good job you idiots. Thats a class action lawsuit for 4 dollars.

Ironically, this is more than the payout in a number of large class-action suits.

    How about this!

I sent my 360 in for repairs because it RROD'd on me and I got a brand new one. Can't access my XBLA games when offline, etc etc. Fine. They sent me a one month gold membership card as a form of apology that my 360 broke in the first place, which was a nice thing to do. I had been a silvermember and had been saving up my one moth card for the holiday season. The damn outage tripped me up and activating my goldmembership took quite some doing... Then after I did manage it, through the creation of a new account which I had to do anyway on account of my Hotmail address being lost and all, I got regular freezes in Brunout Revenge, the one game I had been looking forward to playing! Cost me a week's worth of progression up the leaderboard. I want my free game!
