Traffic Lawyer

My brother got a speeding ticket today in my car while I was letting him borrow it. I was wondering how this will affect my insurance, and if it will, does anyone know how much a traffic lawyer typically is. It was only a 54 in a 45.

I'm sure this'll vary between states and countries and whatnot, so you'll have to let us know where you live. But I'm pretty sure every place I've ever lived, something like a speeding ticket is only recorded on the license of the driver at the time, not the vehicle.

The vehicle registration and whatnot is recorded for information purposes, but the owner of the vehicle has nothing to do with it, so things like your insurance rate shouldn't change at all.

I live in south carolina and I have tried to google up that information but everything I read is either ambigious or conflicting information.

Is this his first ticket? If it is, you don't need a lawyer, that's the biggest waste of money I've ever heard of, no one gets a lawyer for a speeding ticket.

All he needs to do is pay the fine and then sign up for driving school, you avoid the insurance company even finding out about it.

But I'm also not sure if your insurance would go up, even if it's your car, if you weren't driving it.

You could use the following formula to see whether it's worth it to get a lawyer:

If cost of ticket + any education programs > cost of lawyer/P(x) of lawyer getting him off, do it. My suspicion is that it wouldn't be worth it. But for this sort of thing, you should find somebody who will charge a fixed fee for the one, perfunctory court appearance this should require.

If that speeding violation was a felony, it would be worth it to keep it off you record. If he runs the risk of losing your license from the violation, it would well be worth it then.

His brothers actions cant cost him his license, that makes no sense.

As one who lives in the state in question and has gotten many speeding tickets here, as long as he has his own license your insurance won't change. The SC speeding ticket form doesn't even have a field for Insurance policy # or anything. For a 4 point ticket it's really not worth hiring a lawyer over unless he's going to lose his license over it. Just have him request a reduction in penalties or see if he can contact the officer who gave him the ticket and ask to plead to a lesser offense prior to the court date.

Thank you guys so much, this is acctully his first speeding ticket, the reason I am so worried about my insurance finding out is because it was so hard for me to get my car insured for its actual value as it is a very powerful custom car.

That may be part of why he was speeding in it, then. :P If it is that special, it might be a good idea to be picky about who else drives it and when.

I would normally agree with you, however I was following along behind him in my truck and he was going with the flow of traffic, we should have known to slow down as the area we were in is a notorious spot for cops to sit where the limit drops from 55 to 45. I am actually not really mad at him after I have thought about it, I just don't want issues with my insurance carrier.
