I'm subletting my apartment and I found someone who wants to take it. But, the problem is, she lives in the US (I'm in Canada) and won't be able to sign anything in person. What I want to do is email her the contract in .pdf form, she signs it and sends me a deposit for the first month's rent and once the cheque clears, I send her that contract with my signature on it. My question is, is this legally binding?
i believe it is as my friends parents bought their home in hawaii while living in China still. it took longer because everything had to be mailed as it could not be faxed signatures.
