Good and bad news. New Wii update (3.4) is out, or should be out in your region pretty soon. Good news is that it improves SD-card speed dramatically on better brands. Some reports suggest that 90 blocks file could be copied into system in less than three seconds*. In addition it adds support for USB keyboards on Mii Channel. And then the bad news. New update blocks installing homebrew completely, and in the new system terms, Nintendo claims right to update system without further notification.
* Meaning that even biggest WiiWare game would take 11 seconds or so to copy.
EDIT: It is now confirmed that new patch doesn't affect already installed Homebrew channels.
We may without notifying you, download updates, patches, upgrades and similar software to your Wii Console and may disable unauthorized or illegal software placed on your Wii Console to ensure that your Wii Console is operating properly and efficiently, comply with applicable laws, assist law enforcement, protect us and our customers, or prevent the use and distribution of software obtained through improper channels.
I understand this is most likely because of the Homebrew Channel, but this concerns me greatly with regards to the part of the agreement that already existed in regards to everything we buy on the Wii Shop Channel.
Article 12: Expiration and Termination of Agreement
* You may cancel your Wii Shop Account by contacting our customer-service department or by following the instructions in the Wii Shop. If your Wii Shop Account is canceled or terminated for any reason, you will no longer be able to use the Wii Shop. You will lose all downloaded Content and forfeit any rights to any unused Points, which become our property.
* You may terminate this agreement by removing Content from your Wii Console, discontinuing use of the Wii Network Service, and forfeiting any rights to Points in your Wii Shop Account, which become our property.

So now they really can just take away everything we downloadably bought while we sleep whenever they felt like it. Maybe they could before, but this really hammers the point to everyone.
Now I wonder what happens to the channels we've kept on an SD card. If the above scenario were to happen, and if we were to try to put them back on the Wii's main memory, would we be denied?

Yeah, I read through the agreement when I got the update.
Pretty scary stuff. I never even really got around to installing the Homebrew Channel, either. (By the way, did you see the part where the Homebrew Channel voids your warranty?)

It's typical legal lingo. In legal terms, you have never owned any of the computer / console software you have purchased, you have only leased it, and paid for media on which it has been stored. It's creator's property.

The only traces of it on my system (that I'm aware of, at least) are the save file and the logs with Twilight Princess scattered all over. BTP, such agreements are widespread if you bother to read them. people often agree to agreements where the service provider could delete your whole hard drive and not be considered responsible!

I read the agreement when I started doing stuff with the Wii Shop Channel. I knew that some stuff sucked, but figured Nintendo needed to cover their ass whenever a time comes where they actually need to cover their ass. That, plus the messages Nintendo sends to our Wii-mail alerting us of updates, made me think "they could, but they probably won't" about what I said before.
Thank god for those faster SD transfers. I tested it out and N64/Wii Ware games now take about 10-20 second as opposed to 10 minutes. It could still be better but I'll take it.

So, here's my question: Is the "worst case scenario" just that the Homebrew Channel gets removed, or could anything else bad happen to the Wii? Depending on risks, I may at least advise my friends to remove the Homebrew Channel, whether or not I do myself.
Urg. Fucking hell, Nintendo. I'm not updating until you stop fucking around with homebrew.
They won't, just so you know, because it enables piracy. And I kind of hate them for it. I use homebrew because I am a computer science student and programming is my hobby, and I want to program for my Wii. What is wrong with that? Nothing. Microsoft understands this. :x
I don't blame Nintendo for this at all. I do have the Homebrew Channel and make regular use of it, but I totally understand Nintendo's problem with it. Specifically, the Backup Loader.
You can now (via homebrew) get all the advantages of this update without the anti-homebrew measures, although it's probably better to hold off for something more robust.

Also, I'm kind of glad they are shutting down some of the homebrew to prevent piracy. I have a friend who put the Homebrew channel on his Wii, ONLY to pirate games. He has like 50 ISOs on his computer that he will burn to a disk to play them.

This is why I'm confused by people who get pissed at Nintendo for this.
They're supposed to ignore the huge percentage of people who use wii hacking for pirating software because there are a few people who use it for legitimate homebrew things only? Really?
I mean, what did you guys expect? We all know why this is happening.
I wish they just blocked those illegal applications instead of hurting those of us who only want the channel for region-free games.
At least the HBC isn't affected, but I'm not updating. If anything, Nintendo is the one that is going to be the one affected by this, since I can't access the Wii Shop Channel because of that.
Not that there are any games that I want to get on the VC or WiiWare right now, though. I'm sure there will be in the future.
Those terms of use frankly frighten me a bit. I may actually uninstall my homebrew as I'd really hate to get my account shut down. Sucks, but I guess it was fun was it lasted (at least the DS homebrew scene will continue to thrive).

SUPPOSEDLY you'll be able to access games on your SD card directly from the Wii Menu, though. A hunk of space on the Wii's internal memory will be set aside for temporarily loading games you wish to play that are on an SD card.
Which is good enough for me, so long as the SD transfer rate is nice and fast.

Software piracy is illegal in and of itself. This whole thing is not fair to people who use homebrew for legitimate purposes to run software on hardware they own.
Of course, when you think about Nintendo's history (remember, they stuck with cartridges for so long for similar reasons) none of this is at all surprising. The thing that really sucks now is they can:
1) Send an update to your Wii without telling you
2) Said update can check your Wii for homebrew software
3) If any homebrew is detected, your online account for the shop and whatnot is shutdown and content you bought is locked-out, and your Wii can no longer use WFC

At the moment, the only people they have really screwed over are people who are yet to install the homebrew channel, and wish to.
If you have the homebrew channel installed now, I am pretty sure there is a workaround for everything else.
They have prevented "WAD installation", which could be used for several things, like installing custom made channels. The most common use seems to be piracy of Wiiware/VC games. However, it looks like it is pretty simple to find a workaround for all of these. I've not updated to 3.4 myself, so I am not 100% certain on all this.
As is stands, there are (at least) 3 things that Nintendo is attempting to stop with firmware updates:
Wiiware/VC piracy
Effectively these are the same, the procedure for users doing them is basically the same, and the loss of revenue is basically the same.
To pirate Wiiware/VC games requires users to have a homebrew enabled console (basically have the homebrew channel installed), then they just download a wad for whatever game they want from the internet, and install it from the SD card to the Wii console with a piece of homebrew software.
This new firmware attempts to prevent this by A) Blocking the install of the homebrew channel (but it will not effect existing installs). Preventing WAD installations. This was a good idea in principal, but I dislike it because WADs can be useful for legitimate homebrew uses, and also it was really easy to find a workaround for (and indeed, one has already been found).
Region Free Gaming
This is basically out of the bag now. I've not used it yet (not imported any games yet), but anyone with the homebrew channel installed can pretty easily play imported titles.
The only potential importers that this update harms are those yet to install the homebrew channel.
Retail Wii games piracy
It is possible, through the homebrew channel, to get homebrew software that allows you to play DVDr backup games. Users could use this to download disc images off the internet, and pirate games without any hardware modification.
The only potential pirates that this update harms are those yet to install the homebrew channel.

I use a MicroSD card in a SD adapter. I wonder if that'll hamper it any.
