    Nearly the exact same thing happened to my girlfriend's sister. From a stop, she rolled forward and lightly rear-ended the guy in front of her. There was no damage, but they exchanged insurance information and nothing else came of it at the time.

    Years later, the guy tried to sue her, apparently claiming that he had actually been injured and wound up losing his job as a result.

    I didn't get many details, but from what I know, her insurance company did the battling for her. After all, they'd be liable for covering those costs, right?

    So, I'd definitely call your insurance company, possibly before getting a lawyer yourself (though both should be a priority to be on the safe side) in case they're handling it.

    The insurance company you had at the time of the accident should have lawyers on retainer for this kind of thing. Also, I would imagine that you calling this person's lawyer would be a bad idea.

    Your insurance company almost certainly has a duty to defend. Call them, give them what you've got, forget about it.

    True enough, but best leave out commentary like 'bitch'. Particually when this is the first hit for "Carbondale, IL sued"

    As for the case, yes, probably just looking for a settlement not based on actual injuries. Talk to your insurance ASAP, and follow their advice. It's in their best interest as well not to pay, so they're on your side.

    I would say talk to your old insurance provider before you talk to her lawyer. They will probably take care of the whole thing, and given the old saw that, 'saying I'm sorry is equivalent to admitting fault' it would suck to say anything that catches you in a douchebag-weasel-trap.

    Her lawyer won't talk to you about much untill paper work saying that you are defending yourself goes through. They can get in some serious doo-doo otherwise.

    Don't call the other paerty's lawyer. If they have any idea of what they're doing, they will refuse to discuss the case with you at this early stage. At best, calling them will be a waste of your time and at worst put you in aposition where you might say something you'll later wish you hadn't (see G_Pitt's comment on "Sorry"=="My Fault").

    Contact your insurance company. They should be able to tell you how to proceed.

    If I'm reading the OP correctly, are you being personally sued for something that occurred in a company vehicle, or did you mean your insurance company when you said:

    The chances of this ending up in court are slim to none. My best guess is that your insurance company will settle for a few thousand unless her claim is utterly baseless.

    On a side note, the H/A forum get pulled during discovery would be hilarious.

    As someone who practiced motor vehicle insurance defense work for three years, let me tell you that it isn't abnormal for a plaintiff to file a lawsuit as close to the statute of limitations as possible. It allows the injured party to accumulate as many medical bills as possible and inflate the potential value of their claim. Plus, they're hoping that you (the OP) may be unavailable to contradict how the accident occurred.

    Call you insurance company and let them know what you received. They have attorneys retained just for this purpose.

    FYI, don't freak out if your insurance company sends you a letter stating that they'll only cover up to your policy limits and retain the right to investigate if the accident falls under your policy, etc. As long as the accident occurred the way you described it (and you didn't leave anything out, like the fact that you were chugging a bottle of whiskey at the time of the accident) it'll be covered.
