My bet is that it's due to copyright differences. Chances are all the works are public domain in the EU, but still copyrighted in the U.S. See also: Animal Farm debacle with the Kindle.
I looked up all of the titles on the Nintendo DS "100 Classic Book Collection," and for every single title on there the copyright term would have expired in the United States. The last one to go would have ended in 2000 at the latest.
So it's not a copyright issue with respect to the books on the actual game card, as all of the books on the game card are now public domain in the US.
Animal Farm is still under copyright protection in the US and will be for another decade.
