what matters is that folks who paid $5 for the browser now have 500 points to spend on a game. Whether they considered the $5 a sunk cost, and they consider this game to be free, or if they are considering this a return on their $5 investment is a matter ONLY for their personal books, and WILL vary between folks depending on how they chose to budget and account for their own finances.
For the sake of tax purposes can I write this off as a gift or do I need to report it as income?

I'll double check for you, but I believe that you can justifiably consider this to be reciept of something that you had purchased during a previous year, rather than new revenue. For Tax purposes, I would shy away from calling this "free money".
You paid for a browser that was free before you paid for it, and is now free after the fact. I applaud Nintendo for reimbursing people the money for a download that they wrongly charged for in the first place. They deserve respect for that. But the fact is, you paid $5, for something that does not cost money. Hence, your $5 is only now going towards something that actually has a value of $5. I would not call this game free. It's been paid for.
No, the Beta version of the browser was free to the customers that purchased the Wii within the first 6 months.
The final version of the browser which was released I believe in June of 2007 was $5.
That's not true. If you got the Beta version, you could upgrade to the final version for free when it was released.

Do we really need to argue about this?
We have a bottom line here, and that is, everyone gets the latest version for free right now, and if you paid money before, you're getting money back.

I never claimed that if you had the Beta version you had to pay $5 to upgrade it.
Only if you didn't get the initial release did you have to pay $5.

Wasn't intending to start an argument; your wording just made it sound like that. Just wanted to correct facts.
I think we can all agree that Nintendo is doing a good thing by letting people download a NES game as a refund.

Dude it's all PR. They don't do this from the goodness of their heart but for their image, goodwill and publicity. God knows they need it.
Nintendo DOES deserve some credit for doing this pre-emptively, rather that doing this in response to complaints made AFTER making the browser free. OF COURSE they're doing this to garner goodwill, and I'd say they deserve it. What this decision says is that Nintendo is a company that wants to be fiar with you about what they charge you.
What this decision says is that Nintendo is a company that wants to be fiar with you about what they charge you.
Riiiiiight. That's why the price of the Wii is so very reasonable. Especially in the UK. And why they abolished their greatest hits line. And why years-old Wii and DS games are still fullprice. I could go on.
Why do people get so emo about Nintendo? It's really strange.
Because the Nintendo they have in their heads is not the Nintendo that actually exists.
I'd argue that the Nintendo of today is the same Nintendo we've always had.
And I would agree with you. But some people have built up an image of Nintendo that really isn't Nintendo, and when they fail to live up to that image, people get pissy.

The price the Wii at what it will sell for. No one is forcing you to buy it. Why would you expect Nintendo to price the Wii significantly lowerer than the market will comfortably have it at? They'd take a large hit to profit, and without a significant enough upswing in sales to counteract it, since the Wii is ALREADY selling great.
The fact that Nintendo is issuing refunds WITHOUT waiting first for complaints is an EXTREMELY consumer positive move that should be encouraged. Mock outrage about how "all they want is your money" is a bunch of childish bullshit. OF COURSE they ultimately want your money. EVERYONE wants your money.

Yeah I don't get the complaints about the Wii's price, their competitors have lowered prices because they have to, nintendo doesn't.
Company makes the most profit it can, THOSE EVIL BASTARDS!

I would like some money because these are artisanal nuggets of wisdom philistine.
Yeah, nobody was complaining that Sony was stealing money because the PS2 price was holding for so long.
It's always been, the market leader's console price is always pretty stable, and the other consoles always have to price cut to match the market leader. For the first time in history pretty much, the other consoles started at twice the price of the Wii, instead of everyone starting at pretty much the same price.
It would be just stupid to drop your price when you are stilling selling like hotcakes. A Wii pricedrop will come once sales start to slow down.
I imagine the reason that Wii Opera went free is probably because it was either not selling that great and they figured it was better to let everyone download it so they could make it a bullet point about the console, or Opera wanted it to be free to get people looking at the Opera name.
Either way now, both the PS3 and Wii have free browsers, and so far the 360 is the only internet-capable console that is not capable of some form of browsing.
I'm gonna ask again, cause the question got a bit lost in the conversations about Y DO YOU LOVE KIDTENDO FOR UNSTEALING UR MONIES?!?one
God, it hurt to type that.
Anywho, I was hoping new Flash would work with stuff like Hulu, but no such luck. What is the upgraded Flash good for, then? Are there awesome sites for armchair browsing that I can now access?

To use your sarcasm as a jumping off point: Don't judge a company for MAKING a profit, judge it by HOW it makes a profit.
If it makes that profit by producing a product that consumers want, and attempting to treat them well in order to build up loyalty and goodwill, then that is a good company.
If it makes that profit through playing games with the market, forcing consumers to choose between their product and nothing at all, or uses outright deceptive tactics in order to trick consumers in to parting with their money, then that is a bad company.
Both scenarios, the company is "just trying to make a profit."

Well, YouTube works again if you used to use that. I don't know if HD videos will work, but the regular ones will.
And from what was said in the thread, it doesn't look like Hulu works on any conslole browser.

Fail.
I was hoping to watch some Mad Men on my tv without having to use a media server.
You could get AMC, like the plebs?
Meh, I just stream the show off of the CTV website.
I'm quitting smoking, so as of right now I really shouldn't watch it anyways.
Oh christ.
smokes.
To make me feel better, can someone tell me why I care about the upgraded Flash? I'm not joking, I'd really like to know what I was just given.
For the sake of tax purposes can I write this off as a gift or do I need to report it as income?
