There's also something about privacy laws being such that you can't be compelled to disclose the results of a test for HIV, so the entire system is on shaky legal ground.
don't porn stars get monthly screenings for HIV and other STDs
i could have sworn i saw a documentary about pron several times
What does your clean test from three weeks ago says about your current situation if you've had unprotected sex with multiple partners in the intervening time?
“We have been trying to work within the regulations, but it’s almost impossible,” Duke said. “If we were going with the letter of the law, every film would have performers in latex gloves and goggles.”
but I know some people would probably love porn like that.

except hiv/aids is monitored by the health department

I should have specified in an employment (i.e. private) context.

To say nothing of HIV's dormancy potential.
this isn't the 80's
the detection ability of tests is much better, regardless of dormancy
If anyone sets up a Do Not Call Registry to block phone solicitations from the White House, Rep. Henry Cuellar (D-Tex.) wants in.
Cuellar, a fiscally and socially moderate Hispanic Democrat from Laredo, tells reporters that he’s strongly leaning toward backing heath care reform – but that he’s been ducking calls from President Obama’s staff because he doesn’t want to enter the wind tunnel of presidential persuasion.

This sounds like a political dodge for a guy who wants to vote for the bill but not be associated with the general backlash when it comes election day.

How would all that apply with porn stars who have sex with the same people; such as amateur porn?
If a husband-wife duo create and distribute pornography, would they be required to wear condoms? That's a bit ridiculous.
There are two things to say here. First, that doesn't look like something that would fall under workplace health and safety legislation. Second, even if it did, enforcement is generally based on a complaint-initiated model, so if barebacking works for both people nobody will even know to get involved.

just for the opening line of the comment from the court on the ruling:

that show ruled
did you notice that one of the episodes used the Chronopolis theme as background music?

and technically the actors/actresses cannot legally be compelled to submit to the tests, but good luck getting work after it
I thought the average detection was still a few months out. That article just seems to point to earliest possible detection. I dunno, though.

The entire point of his post was that they won't get any work if they refuse the tests
it's a matter of public safety and the findings are still technically kept private
The end.
"as early as"
