I don't know the make up of the dems to republicans in this vote, but it's looking like this was another thing on the List of Things to Quash to Make Obama Look Bad in 2012.

legislators have a fiduciary responsibility (even if it can and should not be legally recognized) to their constituency as well as to the nation as a whole, and it ought to preclude them from voting against the interest of the country and against their conscience

This will probably continue to be blocked until Republicans can oust Obama. It's clear they're willing to change stances for no other reason than political posturing so if we end up with a conservative president in 2012 I would look forward to seeing all those win-win pieces of legislation being passed with no resistance
Gradual, nonviolent change is a lot more preferable than pretty much any alternative. The reason that such shitty politics are going on is because the people want it, because the people don't know any better. Other than educating the people there really isn't anything you can do (aside from getting politically active)
