    I mean, we have actual concentration camps with children dying in them and people are trying to defend them.

    On the bright side, now that the news of our aCtUaL cOnCeNtRaTiOn CaMps is out, I can only assume that people have utterly and completely stopped streaming over the border in order to enter those camps. I mean Mexico might be rough, but I have to assume it's better than walking a hundred miles through the desert to volunteer for Auschwitz.

    Deny, deny, deny, typical. Ignore the science that Cobra Commander's Weather Dominator is helping save human lives, just because it caused the twisting conflagrations that turned Central Asia into the lands we now call The Unending Central Firenado. Weather production isn't the problem here. With modern science, we produce enough weather for every human on the planet. It's the distribution of said weather that's the problem, and at the end of the day, like all things G.I. Joe gets their hands on, it has turned into a political football.

    I wonder if some of the defenders are just part of the generation that is always plugged in. They are connected to the internet 24/7. Always chattings, always streaming, always talking. Or they aspire to, as much as material concerns and parents will allow them.

    It's an existence utterly alien to me. But I see it around me. People with their skulls constantly arcing towards their phone. People walking around on calls as though the rest of the world around them doesn't exist. Including just walking into a bathroom for a nice loud shit in the stall right next to me, still on a call.

    To a certain person in a certain technological immersion, the presence of the internet in the bathroom is a nonfactor. Chat, audio, video, I can see these distinctions blurring or vanishing.

    Me personally? Not at all.

    At the same time, by the letter of the law I guess this guy did wrong. But also I've seen the "incriminating" video, and to hear people talk you'd think he captured just tons of 13 yo dicks flapping around. He did not. Even in bathrooms, men are usually more discrete with their dicks than that. He got footage of a line, men's backs, and people at sinks washing their hands. The usual things you see in a men's bathroom.

    I donno. I don't really have a dog in the fight. Feels like watching two foreign tribes just fuck each other up halfway across the world.

    I get what you're saying here. People shouldn't make non-factual claims. Yes, if he had actually caught people with dicks in their hands on camera, that would have an even worse effect on their victims.

    But I don't know that it really lessens the offense. I'm very happen that law has those letters. If someone sets up a camera pointed into my bedroom and broadcasts a week of footage, the fact that I didn't do anything noteworthy in that week doesn't really make it less outrageous behavior.

    Well, the Texas penal law I posted earlier is pretty clear that all you need for illegality here is just filming in a bathroom, whether you actually catch anything on camera or not. Filming in a bathroom or changing room by itself is enough for a felony.

    Here is the California version of that penal code, and I think it's still pretty clear that it doesn't matter what you actually SEE with the camera, just that you have a camera in a bathroom at all:
    (j) (1) A person who looks through a hole or opening, into, or otherwise views, by means of any instrumentality, including, but not limited to, a periscope, telescope, binoculars, camera, motion picture camera, camcorder, or mobile phone, the interior of a bedroom, bathroom, changing room, fitting room, dressing room, or tanning booth, or the interior of any other area in which the occupant has a reasonable expectation of privacy, with the intent to invade the privacy of a person or persons inside. This subdivision does not apply to those areas of a private business used to count currency or other negotiable instruments.

    Though I guess the California law includes "with the intent to invade the privacy of a person or persons inside" that the Texas law does not include. Which I suppose he could argue he wasn't trying to invade anyone's privacy?

    Yeah, I mean, I don't want to come off as going to mat for this guy. I'm mostly just confused at the reactions on both sides? Like the guy recorded in a bathroom. That's clearly wrong and stupid. At the same time, people breathlessly condemning him invoking child pornography just seems extreme?

    The whole bruhaha just seems like this weird alien conflict on another planet to me.

    Likewise, the letter of those laws, I guess he violated them. But I'm not sure he violated the spirit of them? Like he was filming himself openly. I've only ever seen those laws wielded against people planting cameras to secretly record people at angles that expose them.

    So it's like, clearly I'm ok with him having some punishment. I'm less OK if that punishment is exile from social media, a jail sentence, and being on the sex offender registry for life. A punishment that signals "This is not ok stupid." Not a punishment designed to crucify him.

    And the reason I personally brought up porn in regards to this is because I very recently dealt with a grand jury case where that's exactly what recording in a bathroom was for a certain guy. Like it's not what gets me off, but that doesn't mean it isn't a very specific kind of porn.

    Like to try a different example, supposing he recorded his twitch while having a woman in heels stomp her foot on his face, while they're both fully clothed. That'd be porn. You can ask people who draw porn commissions - that's the sort of thing they get paid to draw sometimes, because it's someone's kink. The difference is that in that case the woman would presumably be an adult and would have consented to the arrangement.

    And what's funny (well, not haha funny) is that this isn't even one of those cases where you can (futilely) plead innocence. I mean, c'mon. Do you really think it's legal to record in a bathroom in any US state or even in any country? I'm pretty sure the default answer for that is "no" without even cracking open wikipedia.

    The only real question you'd have any doubt about is just how illegal it was.

    Yeah, it's one of those things that fails the reasonable person test. A judge may accept an ignorance excuse if you fell afoul of an arcane and obsolete law prohibiting riding a horse while wearing a hat.

    A similar claim that you didn't think filming in a bathroom would be a problem will be met with "tough, you should have. "

    Reminds me of that youtuber kid who recorded some dead body in Aokigahara forest in Japan known for suicides, or something. He got a slap on the wrist from youtube, demonetized ads and everything, and was back within a week, recording himself telling people to eat more Tide Pods.

    Even the YouTube CEO was commenting that he did nothing to really deserve it, and they "can't be pulling people off their platform."

    it is a breach of norms too... the post-modern humor of detaching context from consequence runs this risk of disassociating civil behavior from performative behavior and streaming something on your phone is something that civil law is going to be struggling to keep up with for decades... the quick fix is going to be either authoritative shift in policy or juvenile exploitation of latent norms... getting people less addicted to their phones is the band-aid but more importantly is the recognition of sex crimes as not something to spin on your resume as cutting edge... which isn't necessarily on this guy's mind, but is characteristic of the direction of the social attitude toward neglecting trauma as a digital notification to allow or dismiss
