I would argue that once the resources of the state are involved in faking something it should just be assumed that it's going to fool people. To the point where I'd argue it should just be presumed in court, and the government isn't allowed to argue otherwise.

None of that happened. Worried that Carlos might infect other migrants in the teeming McAllen facility, officials moved him to a cell for quarantine at a Border Patrol station in nearby Weslaco.
By the next morning, he was dead.

A group of doctors were arrested for blocking a Border Patrol facility because doctors are not allowed into the concentration camps to give flu vaccines. Influenza is raging through the overcrowded and unsanitary camps and has been for months. It's all petty cruelty, making the migrants suffer and die through neglect.
Which made me start thinking: the flu season has started much earlier this year in the US than before, and Influenza B is the one that spread the first and fastest too, which is also unusual. Spanish Flu is widely believed to have been bred in the giant hospital camps of World War I, where too many people were crammed into too small and unsanitary conditions where disease could spread widely and freely until it mutated into a pandemic form. I suspect the camps helped kickstart the early flu season, and we are creating conditions to breed super-strains that would inevitably spread into the rest of the population. Disease doesn't care about which side of the fence someone stands on.
And frankly, if we created a pandemic out of our evil petty cruelty, we would deserve it.

The whole point of concentration camps is that disease does the genocide for you. The original ones - the Boer camps run by the British in South Africa - killed 28,000 through disease.

The notion of a concentration camp goes way back to the 19th century, the Boer War. They were British inventions, built in South Africa, to house the men, women and children made homeless by the conflict, refugees. You see, everything is much older than we think, and everything old happens again.
But, actually, it is worth pointing out, when we consider these Erstwhile Sites and how to make them work, they will never stop filling up. Never. Absolutely never. These problems will never go away. I can see the vast migration of people stretching ahead for centuries.
So, what if we look back through history? Because the British found a way to empty those camps in South Africa, all those years ago. They simply let nature take its course. The camps were crowded, they were pestilent, they were noxious, they were rife with disease, which was on the one hand regrettable, and on the other hand fitting, because a natural selection process took place, and the population of the camps controlled itself. You might call it neglect, you might call it efficient.
And it was Kitchener who did this. Kitchener. "Your country needs you."
And let's say another word, because some people call this policy genocide. But have you ever heard of it? The camps, the Boers, the result. Have you? Have you read about it? Were you taught it? - Do we remember it? - No. We forget it, because it worked.

I suspect the camps helped kickstart the early flu season, and we are creating conditions to breed super-strains that would inevitably spread into the rest of the population. Disease doesn't care about which side of the fence someone stands on.
And frankly, if we created a pandemic out of our evil petty cruelty, we would deserve it.

I guess my question in all of this is how does it not rise to the level of criminal negligence? This is so clearly outside the lines of qualified immunity (just doing my job, ma'am) since it's objectively an offensive level of incompetence & malfeasance driving the outcome in such cases.

The whole point of concentration camps is that disease does the genocide for you. The original ones - the Boer camps run by the British in South Africa - killed 28,000 through disease.
It's still the point, but Americans love to coat their crimes against humanity in denial, feel-good PR, and the kind of racism that blames children for coming here and "bringing their diseases with them."
