    This sounds like it could end up being a class action.

    with what money exactly? would parties that have not been affected, and which (potentially) may never be affected, be willing to plonk down the enormous amounts of dough needed to fight youtube and possibly the japanese government

    I don't think there's enough of a class consciousness for that to happen tbh

    iirc the last time something like that made news in any noteworthy capacity it only occurred (and got resolved in a pro-consumer manner) because the person it happened to was TotalBiscuit, at the time one of the most popular creators on the platform, with a motivated fanbase at his side to flood youtube and generate enough bad PR for them - and that was within the bounds of US copyright law only

    as I understand the fanwork scene in japan exists entirely in a "this is technically illegal but it's tradition and people will get mad at you if you break the unwritten rules of allowing it" grey area where the rightsholders simply don't acknowledge it

    It makes perfect sense when you realize they permit the fan work market because it's their own people. It's based in Japan and the people in Japan, whom they can rifle through and pick up the good ones.

    They can't do that with people outside Japan, so they don't see any reason to allow the same market to exist elsewhere. Because Japan is still very xenophobic.

    My understanding is the companies are extremely draconian about anything outside of their immediate sphere of influence. See Toei sending a C&D letter to Latin American countries for broadcasting Dragonball Super publicly.

    Also class action suits are frequently initiated by law firms who have received a few complaints and see an opportunity. The firm usually gets fees out of the settlement and sometimes retains the unclaimed portion of the settlement that class members don't collect. I believe they are mostly filed with no upfront cost to the plaintiffs.

    This was how it was with western fanfic up until recently too. Weird kind of stuff. Until people gave up. And Twitch! Copyright doesn't work.

    The Western fanfic scene was famously hounded by Anne Rice at the turn of the century which made her a big enough pariah in the community that they celebrated her death. On the opposite side of the coin, one could say part of why Harry Potter ended up so popular was Rowling's explicit acceptance of fanfiction (too bad she burned all that good will with TERFery).

    Not just fanfiction. Much of what made HP the phenomenon it was is that you could keep mainline HP content even when you're caught up on movies. There was always more fanfic, silly YouTube videos, and at least three full produced unofficial musicals.

    I remember in high school band, our director tried to teach some of us how to circular breathe (I think that's the term for it). It's insane whenever I see it done - especially that smoothly, where you can hardly notice where the airflow changes.

    I sorta figured it out when I played the saxamaphone but then I was like "I hate the saxamaphone" and stopped playing it and now I probably can't do it anymore, I don't remember the mechanisms
