Don't think Jerry said he thought it justified it. Just that he at least understood why Epic would cry out that they're being singled out. It's entirely possible to understand a person's (or in this case, corporation's) excuse without agreeing with it.
Caveat emptor is good life advice, but it can't used as legal or moral justification for corporations' bad behavior, as they will always exploit their power and information asymmetry to take as much from the customer as they can get away with, no matter how much the buyer tries to be careful.

Correct. Both things are true. And since ultimately the legal system is rigged to slant towards the people with money, you'll be wise to caveat fucking emptor just as hard as you can. Doesn't mean you won't get screwed anyway, though.
Fun fact: Caveat Emptor originated as a legal principle that once a sale was closed, the seller was absolved of any defects in the product. Eventually, society decided that was stupid.
