New Supreme Court decision just released
So here in MURIKA™ we got this thing called the Supreme Court (SCotUS)
And who's in charge of this operation?
This guy. Chief Justice John Roberts of the Supreme Court of the United States. Recognize.
Roberts' is generally regarded as a conservative who was appointed by Bush. Originally intended to replace Sandra Day O'Connor, Roberts was "promoted" to appointee for Chief Justice when the sitting Chief, William Rehnquist, died.
But now that's all changed. Roberts has twice voted in favor of the Affordable Care Act (ACA / Obamacare). In both cases this was regarded as an activist decision by some, and an extremely canny political navigator by others. Notably, in both ACA-related cases, the decision was 6-3, Roberts voted with the majority, and wrote the majority opinion.
Among other points, Roberts offered the following:
Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them...If at all possible, we must interpret the Act in a way that is consistent with the former, and avoids the latter.
The context and structure of the Act compel us to depart from what would otherwise be the most natural reading of the pertinent statutory phrase...
Scalia, who wrote the dissenting opinion had this to say:
It rewrites the law to make the tax credits available everywhere...We should start calling this law SCOTUSCare
In upcoming/related news, the Court is also set to announce a decision on marriage equality. Watch this space for more.
