So if people bring frivolous lawsuits against people like this, and lose, do they have to pay for the defendants legal fees?

    Just file suit against them

the sue happy culture exists because they might not get stuck with the bill and moreover juries tend to favor the plaintiff for some stupid reason

i blame the fact that juries consist of average people, who aren't intelligent or educated enough to understand the legal system

gotta give it to lawyers... they realized that most people are not that smart and that most juries consist of those people and they ramped up the difficulty of legal bullshit so that juries will be baffled by their bullshit

There's a bit more than meets the eye with regard to why Worlds.com is pursuing this lawsuit, why they're targeting NCSoft specifically, and why they're pushing for this to be in an East Texas court system.

What a terrible comic; three times the same panel just to make one lame "joke" that has been made a million times.

I hope they drop the retarded art style for some actual art, and try to focus on some original material instead of some lame commentary like this "frivolous lawsuits are frivolous... lol!!!!" bullshit.

Well the problem appears to be that the lawsuit isn't "frivolous" but rather their patent is incredibly broad. If worlds loses it would be due to their patent being considered invalid/unenforceable.

There's no way this will fly. Even if they get cash from a foreign maker, it will greatly effect American game makers like say MMO champ Blizzard and just getting some good buzz and momentum EA-Mythic.

There's no way the movers and shakers won't warn all the right people about how this bullshit case could take money out of the hands of American businesses too. Businesses that pay taxes, lobbyists, and create jobs.

Its typically called "Loser pays" and the United States does not have a loser pays system. There is a push to implement it, but the trial lawyers are against it. They pay huge money to the democrats who then kill all attempts at loser pays legislation.

Can't you countersue for legal fees? "Countersuing for legal fees" sounds like a term I have heard. Maybe I am just misunderstanding what it means though!

Why do people keep mentioning juries with regard to this suit? Most civil trials do not have a jury (and in most cases are not warranted.)

it means you show up to their house with two sacks.

In one sack you put anything you want of theirs, so as to cover your legal costs and the cost of travelling to their house.

In the other sack you put them, and then light the house on fire.
