ok so i have asked microsoft but they have been giving me the run around for several months now. I started a clan by the name of video game anarchy and i have a logo that would make a good gamerpic but i cant find a way to get microsoft to publish it to the marketplace. so i thought i would check here since penny arcade had gamerpic up so someone here might know.
The only community-published gamerpics that have made it onto the marketplace have been from very well-established Xbox fansites, and then their pics were collated in a pack with every other community site at the time. Even then, it was a rare thing to have happened.
Cheap Ass Gamer attempted it once, and found out that they would have to pay Microsoft in order to do it. This may have been because they wanted the download to be free, but I don't remember if that's the case. They would also have had to have been part of a pack with other community sites.
If you want your logo as your gamerpic, the best way is to take a picture of it with an Xbox Live Vision Camera. Only your friends will see it, though.

The folks are PA would probably just refer you to MS, since...MS is in charge. That said, you're probably just wasting your time. Like Willeth said, you gotta be pretty well established to have this done. Otherwise everyone would be publishing gamerpics on Live.

So it looks like you would need to have a licensed publisher pursuant (whatever that is) and the Dev kit/publisher license in order. Tough to get unless you are a developer/publisher intending to create and sell content (retail games, XBLA games, etc). The XNA publishing channel does not include the ability to publish things other than XNA games (such as themes and pics) as far as I know, so I don't think that would help either.
