Ok so I am going to RMA this HD 4870, but I am a little uncertain as to whether they will replace it because I changed the thermal paste on the fan, and this is what they say it won't cover:
- Software or drivers provided by XFX or third parties.
- Problems that result from: (1) external causes such as accident, abuse, or problems with electrical power, (2) usage that is not in accordance with product instructions, (3) failure to follow the product instructions or failure to perform preventive maintenance; (4) products that are not in their original condition or that are not complete with all original components, or (5) problems caused by using accessories, parts, or components not supplied by XFX.
Does this mean they won't accept it simply because I used an after-market thermal paste?
Only if they can tell you changed the paste or there is damage resulting from the paste that is observable (getting a bunch on the board, and say it shorts something out somehow).

If you changed the paste the product is not in its original condition. Not saying you caused the issue, but if they don't cover modified items, they won't cover it.

They probably wont check/care if the thermal paste has been changed. Theyre pretty laid back there. They let me physically drop off my video card and gave me a couple of extra cables/hookups (I needed an S-video to component cable adaptor because apparently Nvidia doesnt do DVI to component or something).
Its totally worth a shot, worst case they just ship it back to you and tell you the warranty is void.
