A Federal Judge in California has ruled that the ban on gays in the military violates the Constitutional rights of gay and lesbian soldiers to due process and to freedom of expression.

District Court Judge Virginia Phillips -- a Clinton appointee -- also wrote that the policy has had a "deleterious effect" on the military and issued an injunction restraining the military from enforcing the policy, though the government may appeal.

The Log Cabin Republicans filed the lawsuit against Defense Secretary Robert Gates, and Phillips cited in her ruling the Obama administration's desultory defense.

"[D]efendants called no witnesses, put on no affirmative case, and only entered into evidence the legislative history of the act," she wrote.

This is kind-of-somewhat relevent to me, because I recently joined the Navy despite some rather homoerotic predilections. :winky:

So SE++, let the celebratory knob shining begin. (Yeah there's probably going to be an appeal and all kinds of other shit but regardless this makes me go wooo)

    Well. I didn't want to make my own thread, and I guess this is the closest thing I have. I would just like to say my brother in law isn't gay, but he did fight pirates today.

    I can't wait to see what they do with this and the Prop 8 case because there's really no good reason for governmental discrimination like this but the Court has been known to justify things it wants to justify

    The Log Cabin Republicans are a pretty small niche group - openly gay people who are otherwise Republicans. I can't imagine the full GOP having anything but venom for this decision.

    If I recall right from NPR, the pentagon has been working on phasing the policy out with a minimum of impact on operational readiness for some time.
