I've been playing a flash game called "Swords and Potions" recently, and I think they've used some Penny Arcade art for their "thug" character, but I can't quite remember which character they've infringing. It's a guy in a black hooded cloak with purple lining and no sleeves, a necklace with 3 skulls, with a neatly trimmed beard.
The guy has the beard, not the skulls.
I thought it could be the Witchalok or Jim Darkmagic, but neither of them have the hood or the multiple skulls, and it's definitely not Death from the Darksiders 2 strip. Help!

Skulls and dark cloaks are not exactly unique to Penny Arcade. He may look a lot like Jim Darkmagic, but there probably is not a case for an actual intellectual property case without opening PA up to other suits against it for similar uses.
I'm fairly sure I've seen that *exact* image somewhere before though, the drawing as used in-game even looks like it's been badly cropped from something else. Still, thanks for the clarification everyone, sounds like it's not Gabe's after all!
