California Labor Code Section 2855. A simple little bit of law that had a massive impact on Hollywood. During the studio era, actors were signed to personal services contracts. Now under California Labor Code Section 2855 these were limited to 7 year terms. But one of the tricks the studios used was an argument that the terms were only valid while an actor was working. If you challenged the studio, then the terms of the contract was suspended. This time would be added onto the end of the existing contract. Oh and in their view, if you renewed the contract or it was in any way modified such as a pay raise, the calendar period would reset. And it will come as no surprise that these contracts had some rather nasty forfeiture clauses if you quit.

That is Olivia de Havilland. She's probably best known for playing Melanie Hamilton in Gone With The Wind, she also stared in a number of films with Errol Flynn. But she grew frustrated with the roles offered her. She was being typecast as the damsel in distress or the wide eyed ingénue. So she started to refuse roles. And Warner's suspended her. Then it followed up insult to injury by loaning her out to RKO for a rather inane comedy. In 1943 she brought suit against Warner Brothers for violations of California Labor Code Section 2855. Now this was risky. Bette Davis had tried this in the 1930s and lost. Her suit moved forward. She won the first round but Warner Brother's appealed. And lost with all three appeals judges ruling that the law was quite clear on this point and the contract could be terminated after seven calendar years.

Warner Brother's attempts to appeal to the California Supreme Court were denied. And the dynamic between actors, actresses and the studios changed dramatically. Now instead of treating their stars like chattel there became a strong incentive to keep them happy. This corresponded to the the rise of SAG as a union. Later on the anti-trust lawsuits would break the remains of the old studio system and give us the modern one.

California Labor Code Section 2855 is now more commonly referred to as De Havilland's Law.

    I have a super common name. Thus I get lots of wrong e-mail. And sometimes the e-mail has that stupid private and confidential clause. I wonder what would happen if I replied to those people and instead of just telling them they have the wrong e-mail address, I tell them they have the wrong e-mail address and I tell them I will be assessing a $35 processing charge for informing them of this.

    The Florida-based company, which had previously raised more than $500 million from Google and other investors, has added on a new round of at least $827 million, though industry sources believe the number may be even higher than that.
