    Anyway, well, that wasn't that much of a reply :P Because I don't see that it is obvious that the same reasoning would apply with the same force without the context of parody. So I could use an argument there.

    But anyway, a major point in that ruling was that by being a parody song, it is unlikely to ever meaningfully eclipse the original, as the court did not find that parodies, well, do that. Parodies serve different markets, as they said.

    But when it is not a parody, and instead a wholesale copy, it is different - there are numerous examples of covers of songs becoming very popular, and more popular than the original song

    EDIT: and yes the last bit is a 180 from when I first addressed that last point in the law about possible harm, I had a smoke and a think

    The problem in pre-YouTube days was that the best version of Sugar High - the one performed at the end of the movie - wasn't the one on the cassette/CD for the soundtrack, instead they only provided the studio version by the original band, which was lukewarm garbage in comparison
