When your 360 game breaks...

I'm looking for some advice.

Recently my Warriors Orochi game for the Xbox 360 developed a hairline crack starting from the center, rendering the game unplayable. Considering that I treat all my discs carefully so I can only conclude that the disk itself is defective or the extreme heat generated by the Xbox 360 caused damage to the disc.

I called customer service of the publisher, Koei and spoke to Joy. She was polite but informed me that Koei would only replace games if they were under warranty. If I wanted a replacement I'd have buy a new or used copy.

I then explained I was willing to pay a nominal fee to have the disc replaced, she informed me they would not do that.

I find this unacceptable. All I want is to send in my old disc with a nominal fee and a get a replacement in return. Many software publishers (Microsoft, Electronic Arts, Ubisoft, Activision) willingly do this, as the purchase of the disc is a license to the software and not actual ownership. This is especially true in the case of Xbox 360 games which cannot easily be backed up. Buying another copy of a 60 dollar game is not my idea of a solution.

What are my options? Am I really stuck buying another copy of the game? What's to stop a company from releasing games on sub-standard discs that fail after six months?
