Modchips now proven legal in the UK

According to Techdirt, which links to a modchip teams website. (i'm not linking directly because it might be breaking the rules)

Apparently "MrModChips" (really? ingenious name there) has had all 26 counts squashed and was awarded full costs. This is a pretty big milestone in that it is now clear legal precedent in the UK. Making the selling and purchase of modchips legal.

    Well that's good, but is the USE legal, and is the prevention of use (Live bannings and Wii brickings) legal?

    I think MS is fine because the terms of use for XBL have some catch-all Thou Shalt Not Modify Thy Console line. If Nintendo is bricking Wiis (damaging your legal property) just for having a chip installed, and not as a "side-result" (chip uses address 0xDEADBEEF, and a game also wants to use that address, OMGPWNIES) then that's shakier ground.

    I would think, because it's Microsoft's service, they have the right to deny anyone acces to Live if they see fit.

    I think banning from live would still be legitimate. Theoretically, it's the same as banning hackers and people using cracked serials from MMOs etc.
