Has anyone else had a problem using the factory given headsets with the Rock Band controllers with online play. I can hear people when I plug the headset into a regular controller and I can communicate with them if I use the RB Microphone but I rarely ever sing. The headset does nothing if I plug them into the drums or guitar. Help?
Most likely? The mute switch is turned on on your headset. It's on the connector that plugs into the controller on the old-style, the new-style has it in-line on the clip.
Otherwise, I believe that if you are using the headset to communicate with others, it needs to be plugged into the peripheral that your online profile is signed into. So if you're playing guitar, you need to plug it into the guitar's port. If you have the older-style 'puck' headset, you'll need to use the adaptor thing that RB came with the plug it in; the newer headsets will plug in no worries.
I'm not sure how it works with the mic but I imagine that a headset plugged into the controller will function as a mic/controller pair would.

I've pretty much tried all of that before and none of it works. I have the old headset and with the adapter it doesnt go in all the way which means it doesnt work at all. I also thought I muted it but its been on full blast the whole time. So Im guessing I just need to buy a new headset and it'll work right?

Possibly.
If you're looking for a new headset I'd say go whole hog. Get one of the ones that simulate surround sound etc.
