What is the law behind putting music in a podcast?
If it's a CD I have bought, am I allowed to play it on a podcast?
What about stuff like "Attribution-Noncommercial-No Derivative Works" licenses, that allow "Noncommercial" uses. Technically the podcast is completely non-commercial, but it is attached to a profit generating blog.
What about stuff like free game soundtracks. Like, say, the BG&E soundtrack, which was given away as a free download.

From what I've seen theres a metric ton of podcasts online that have theme music in them. As long as you don't sell the podcasts themselves, with the music included, I don't see how it could be a problem.
I'm sure it's still bad, but Itunes doesn't seem to be shutting anything down.
Hell, Gabe uses all kinds of music in his youtube stuff and doesn't seem to have had any problems, at least none that he's spoken of.
I've been looking into podsafe music though, and some of it looks interesting.
