What is the law behind putting music in a podcast?

If it's a CD I have bought, am I allowed to play it on a podcast?

What about stuff like "Attribution-Noncommercial-No Derivative Works" licenses, that allow "Noncommercial" uses. Technically the podcast is completely non-commercial, but it is attached to a profit generating blog.

What about stuff like free game soundtracks. Like, say, the BG&E soundtrack, which was given away as a free download.

    From what I've seen theres a metric ton of podcasts online that have theme music in them. As long as you don't sell the podcasts themselves, with the music included, I don't see how it could be a problem.

    I'm sure it's still bad, but Itunes doesn't seem to be shutting anything down.

    Hell, Gabe uses all kinds of music in his youtube stuff and doesn't seem to have had any problems, at least none that he's spoken of.

    As long as you're not charging for the podcast or making money off of it somehow I think you're free to use any music you like.

    If you think zero punctuation put up a lot of copyrighted music and managed to get very successful before he thought better of it. It is infringement, but I think the absolute worst that could happen is you'd get a cease and desist. If you're small time people won't notice though.

    I think we're cool with what we have to be honest. I don't like the idea of making the show particularly radio-like - we're just a couple of guys sitting and chatting.

    I've been looking into podsafe music though, and some of it looks interesting.
