Scratched door and hinging on retaliation

So let me explain, here on campus since it's technically 'the weekend' there are tons of spots available, including around my car. As I go out to my car a short while ago a friend notes how extremely close a car is parked to me, driver side aswell. A black early 90s honda beater. There's so little room between the cars that I decide to check for dents/scratches(I wish I never did). So I take a look at where their car door would open in relation to my door and find a nice sized scratch in paint. I wanted to break broke their window.

Now I know this sounds elementary and childish but honestly I've had an awful birthday thus far and this was just the last thing I needed.

What can I do? I'd love to scratch their car up but I doubt they'd even notice..broken windows sound nice as well, but I like to think before I act. I feel like If I call campus police they'd just laugh. And to file a report is fruitless considering deductibles and the relative size of the scratch.

I'm assuming the type of responses I will get are something along the lines of "let it go" or "anger problems!@!lol11!!!." I can understand that point of view but it feels so unjust to just say "oh whatever"

So does anyone have some input??

Take photographs of both cars as parked, the damaged zone with the other door in view so it's clear that their door could have caused it, take their licence plate number, and leave a note on their windscreen saying 'Hi, I think you may have dinged my car, please call this number so we can swap insurance details'. If there's no call, call campus police.

What Willeth said. Take a picture of the note as well.

I would do that but I went to the store to grab something, had to move my car as a result. Also, my deductible is $400..more than the cost to repair I'm assuming..is it even worth it?

Still leave the note. The point is to get him to pay your insurance costs from his insurers, I believe - I've never owned a car, though.

Problem is his insurance wouldn't cover it because the cars were parked. The OP's insurance might pay it but its a little weird when you know who did it, but the OP would have to pay the deductible even if the insurance company covers it. The OP would then have to take the original guy to small claims for it.

This is why you don't fuck with a mans car and you show respect when getting in and out of your car. I can understand the OPs anger, I personally would look towards revenge as well (I like the removing air from one of the tires trick personally as it isn't outwardly destructive). But sane people would tell you that you should take the legal recourse, which in this case is almost nothing if the guy doesn't want to pay.

Though if you want to go through Small claims, getting the police involved is a must. Otherwise all they can do is maybe write the guy a ticket.

Get over it. It's a tiny bit of damage and guess what

You deductible only comes into play if you are liable for damages. If he caused damages, he's the one that has to pay his deductible, then his insurance pays the rest.

    Assuming:
    1. He has insurance
    2. You contact him
    3. He contacts you back
    4. He agrees that he caused the damages
    5. His insurance company agrees
    6. He actually pays you

    That's a long list.

I decided to write the following note which I will attach to his car,

"Hello, earlier this evening you may recall parking way too close to a car, my car. As a result of opening your door you put a scratch in my car. Instead of retaliating I decided to instead document this and write a note. If you could care less then forget it about it, for now otherwise I will file a report. If you would like to take some responsibility and help me cover the repair costs you can reach me at this number, the choice is yours."

I know it's passive aggressive but..man, fuck him.

Change it to just "way too close to my car."

Also change it to "I have documented the damages and left this note," and leave off the "instead of retaliating" part.

    How about:

    "Hello,
Earlier this evening after you parked next to my car, I noticed a scratch and paintmark on my car that matched the colour and location of your car door. My phone number is (x) and I can provide my insurance information if needed.
    Thanks,
    Me."

I apologize if it seems like I was promoting it. I was more trying to suggest that I feel for the guy (and have had similar incidents before) and know he wants and eye for an eye. My next words were sane people would tell you not to, as in this is not a sane option. Maybe that was why I wasn't infracted.

That said its easy to act all high and mighty without a ding on your car or have a car you don't care if you got a ding in. Next to a house a car is about the most expensive item most people own. Many people treat their cars like its the most expensive item outside their home they own. They get it cleaned, spend hundreds of dollars on oil, change the tires, go in for checkups in what almost seems like every quarter. They manage to get the car from point A to point B every day pitting their car against everyone else's car and driving skill. They do all of this an manage to keep the car looking good and in good condition. Now you go to the store your car is parked, everyone and their mother can see it, they obviously dodged it when parking. To have damage done to you car dependent on the severity may never look right again because some one was careless or didn't care when dealing with multiple thousand dollar possessions should anger people. The fact that unless the guy was of the careless variety, that also happens to be a stand up guy that was also oblivious to the damage he caused, that there is no real legal discourse that won't eat up more of his time any money then he will spend fixing that should be even more infuriating.

If more people cared about their care, then less of this stupid shit happens. Violence or destruction of property is really and mostly never the right option. But to say some one should just get over the fact that someone defaced their most expensive object they own for no good reason should get people pissed.

As for advice on the letter don't give him any options. Say something like "your door hit my door at [loc where this happened] and I have documented an photographed everything. Call me soon so we can talk about this prior to me creating a police report." Something like that where filing the police report might be negotiable without sound like a threat. Chances are he will ignore it, but if the idea of the police calling him scares him he might jump at the possibility of doing right by you. S

I will caution you that since you are in college and park your car near a whole bunch of poor students that have crap cars you are going to have this problem over and over again.

I drove a nice car in college and it was hit parked no less than 3 times. Each time with no note or recourse other than for me to pay out my deductible to have it fixed.

As for your note good luck. But college students can be dumb beasts and be careful about being anything but professional in your note. You may come across someone that just doesn't give a fuck and takes your note and rams it through your windshield. Sure they will be responsible but its your ass with a broken windshield.

And you don't know their situation. They might not have insurance. They might not own that pos honda (borrowed, Stolen, Ect) so just be careful with the notes.

Thanks for the input guys- I guess it's sort of a 'park my car in the middle of no where' thing I'll have to deal with while here.

People are pack animals - If you park far away, someone will park beside you. Even if you're like 20 feet away from the closest open spot.
