Ipod touch skipping out on sleep mode and freezing

I have a second gen ipod touch. I've had it since they started producing the second generation touches, and It's been great to me. Lately, however it has been acting up. Here are the problems it has been giving me:

Ocassionally freezes, seemingly randomly. It will sometimes freeze when I start an app, when I check my email, sometimes when I unlock it (just as the slider reaches the end of the bar), it sometimes freezes right after I unlock it at the home screen.

Sometimes when I try to wake it out of sleep mode it will not wake up, and I have to "reset" it by holding the top button and the home button for ten seconds. This happens very very frequently. I almost never turn the ipod completely off, but just press the sleep button at the top when I'm not using it.

I updated the firmware yesterday, and that helped for about 15 hours, when it didn't freeze or automatically turn off on me. But now it's doing it again. Following the advice on the apple website, I went to the homescreen, and powered it off (by holding the top button for 10 seconds or something). After I did that, it gave me a black screen and has that little "currently thinking" circle that's just been spinning around for about 20 minutes so far.

Does anyone else have this problem? What can I do? Will I have to return it to apple for repairs?
