I live in California. I moved out of my apartment on Feb 14. According to the DCA website landlords have 21 days to return the security deposit for a rental deposit (along with a bill or estimate for any deductions), after which they forfeit their right to deduct for damages.
Saturday will have been 28 days. I sent an email to my former landlord last week (prior to the 7th) giving her my new address, and I think that if she had mailed me a check and/or bill for repairs that I would have gotten it by now.
How should I proceed from here? According to the state website I'm entitled to a refund of my entire deposit since she's missed the deadline, and ideally that's what I'd like to get back, but I honestly don't know what I should do to get from here to there. Should I just send her another email asking for it? Should I send her a letter? Should I be involving a lawyer?
I think you need to give her more time considering she just got your address. I would suggest sending her a letter as Doc suggested and following up with a phone call to see what the status is before taking any kind of legal action.
