My friend is working at Wal-Mart from 8am to about 8pm, basically, pushing carts and helping people load things into their cars and such. He does this five days a week and I would think this would be more than 40 hours. However, he's being told by Wal-Mart that he's only working part time.
Is this right? What should he do?

When I was a COS at Sam's Club I was told that if a part time employee averages more than 32 hours a week for 4 to 6 weeks, I'd have to check with some of the people I used to work with I can't remember exactly, Wal-Mart policy requires him to be made a full time employee. Of course It's been three years since I worked there so it may have changed. However, so long as they stay below that average you could schedule a part timer for full time hours. Of course, a supervisor who allows a part timer to become full time in this way would surely be written up. Wal-Mart prefers part timers so they can screw them with fewer benefits.
Yeah. Wal Marts pay isn't bad. Especially for the mindless work you do. Just don't expect any great benefits. There was a reason that everyone knew how often they could call in sick and not get written up. The insurance they provided for full time employees was horrible and you had to pay for half the premium to get it.
