on the 27th at about 9:00pm I was rear ended by a drunk driver. He fought me in giving me his insurance information and I had to call the cops. Got his information, he drove off, whatever. I called my insurance, reported it, got in touch with my adjuster. Everything is cool, I drop my car off for repairs and I'm instructed to call his insurance about a rental.
I call them, he hasn't reported the accident. 9 days later and they still had no idea he rear ended me. I talk to them about getting a rental, and they say they need a statement from him before they can pay for me. I call him, he doesn't answer. They call him, he doesn't answer. They call him 3 times per hour for 2 hours and he doesn't pick up his phone.
I call him and give him the name of my lawyer and inform him any buisness that has to be done between us will now be done in court. He finally calls his insurance company to make his report.
Everything is cool, I've got my rental. I just paid my bills so i have no money and have to borrow $50 from a friend so that i can make my security deposit. That's bitch slap number 1, but this is understandable I'll be getting it back and they need my account so i don't drive off with the car.
Now I'm being charged 11.99 a day (my car will be in the shop for 2 weeks) and am told that there is no reason that his insurance is responsible for the day to day 'damage insurance' fee that they charge. There was no way to opt out of it.
Why the hell am i responsible for
any of this when I 1. cannot afford it, (yeah 11.99 a day isn't much but I literally make 30 extra dollars a paycheck for food and gas) and 2. didn't cause the accident.
Yeah this is kind of a rant, but what can I do to get him or his insurance to take care of the rental and it's entirety? Should i just return the car to them and tell them and cancel the contract? The person who hit me will not answer my phone calls at all.
Is it possible to talk with the claims adjuster from his insurance to get them to reimburse me?

Also, once both people's insurances are involved, I'm not sure there's any reason or benefit to contacting him directly, and if your roles were reversed I think we'd be telling you not to answer the phone.
Alright, well i called the rental company.
This is what the lady said to me when signing the contract
Me: Wait, why do I have to pay anything? The insurance company is covering this.
Her: Well, the insurance company does not cover any damages to this car, it is ultimately your reponsibility
Me: I can't afford it, isn't there anything we can work out?
Her: Well, you can opt out of our liability insurance and take our lowest damage coverage
me:... what?
they told me they would erradicate the charges after I pretty much went in to hysterics on the phone with their manager.
I'm really stressed out right now.

In the event that you hit someone else or damaged the car or what have you, it's likely your own liability and damage insurance would pay for it, just like if you damaged your own car or hit someone else with it(hence you don't need what they're offering). I'm not guaranteeing your insurance covers rental cars, but it's pretty much the norm.
If that's word for word what happened, the answer should've been "no thanks" to the whole mess. They were like "well ok but you CAN do this...." which is true, but you also "can not" do that if you want. I think.
