The Twilight Rifftrax is phenomenal.
Also, I just watched Angels' Revenge (MST3K) and I'm sad that I overlooked that episode before. It's really great.
yes, but fair use only comes in as a defense to a copyright infringement claim. in other words, PA couldn't affirmatively claim fair use. Best Brains would have to first file a claim against PA for infringement, and then PA would have to argue that they're covered by fair use.
for non-trollish parties, the usual approach is to research first if it's even worth the cost of litigating, perhaps send a letter to the supposed infringer for a cease and desist or some other agreement outside of court. in this case, i'd say even trying to enforce the "theater seat concept" is risky since Siskel and Ebert and a ton of others have pretty much used it, and you can copyright a specific expression (ie published work like writing or film) but you cannot copyright a general idea (the concept of a silhouetted audience in a theater).
